Although this application seeks to reserve all matters, the submitted plans show vehicle access which includes vision splays which are outside of the site curtilage. No notice has been served on the neighbouring landowners. Furthermore, the proposed access would harm the safety and convenience of users of the public highway due to the gradient of neighbouring land which would make visibility at the site onto the highway impractical. The proposed visibility splays are proposed to cross third party land which is at a higher level and outside of the applicant's control/ownership and therefore cannot be maintained. Vehicles would likely egress the site in a reverse manoeuvre due to the proposed tandem parking arrangement which would further limit visibility in either direction and increase the risk to highway safety and to other users of the highway within the vicinity. The development is therefore contrary to policy TRANS5 of the South Oxfordshire Local Plan 2035 and paragraphs 114, 115 and 116 of the NPPF.
