Conditions / Refusal Reasons
The development is inappropriate development that would be harmful to the openness of the Green Belt and would conflict with the stated purposes of the Green Belt, particularly in respect of preventing neighbouring towns merging into one another and in assisting in safeguarding the countryside from encroachment. The application does not satisfy the requirements for very special circumstances as set out by the National Planning Policy Framework (NPPF). As such the application is contrary to Policies STRAT6 and DES9 of the South Oxfordshire Local Plan 2035 and the NPPF.
The application fails to satisfy the requirements of national policy and guidance to demonstrate that all of the agricultural land within the site is necessary for the siting of the proposed solar arrays, and that poorer quality land could not be used in preference to higher quality land. The loss of Best and Most Versatile land throughout the lifetime of the proposed development (40 years) has not been justified by compelling evidence in accordance with the written ministerial statement of 25 March 2015 concerning the unjustified use of agricultural land, which is reflected in policy DES7 of the South Oxfordshire Local Plan 2035 and the NPPF.
Insufficient information has been submitted with the application to make an informed and reasoned judgement on the ecological and biodiversity impacts of the development. The Ecological Impact Assessment (EcIA) (Ecology by Design, November 2023) does not account for the mature scattered trees as a standalone habitat; multiple ecological surveys are out of date and cannot be relied upon to inform the planning process; and the General Arrangement Layout contradicts the Habitat Enhancement drawing (EBD_1712_DR004). In the absence of up-to-date ecological surveys, it is not possible to fully assess impacts on species or consider whether those impacts can be appropriately mitigated or compensated. Furthermore, the current proposal is likely to result in the unmitigated and uncompensated loss of multiple breeding territories of skylark, a priority species. The proposal is judged to have unacceptable impacts on protected and priority species, and fails to accurately account for the net biodiversity impacts of development. These impacts and insufficient information are contrary to policies ENV2, ENV3, and DES1 of the South Oxfordshire Local Plan 2035, paragraphs 180, 185 and 186 of the NPPF, paragraph 99 of Circular 06/2005, sections 6.2 and 8.1 of BS42020, and other best practice guidance.
