The development to which this permission relates must be begun not later than the expiration of three years beginning with the date of this permission. Reason: By virtue of Sections 91 to 95 of the Town and Country Planning Act 1990 as amended by section 51 of the Planning and Compulsory Purchase Act 2004. Related application(s): P24/S1797/DIS

That the development hereby approved shall be carried out in accordance with the details shown on the following approved plans, 30-04 P2, 30-05 P2, 60-05 P1, 20-07 P2, 30-07 P2, 20-01 P2, 60-01 P1, 60-02 P1, 30-08 P2, 30-09 P2, 20-08 P2, 20-09 P2, 30-20 P2, 20-04 P2 and 20-05 P2, except as controlled or modified by conditions of this permission. Reason: To secure the proper planning of the area in accordance with Development Plan policies.

No development hereby permitted shall take place except in accordance with the terms and conditions of the Council s Organisational Licence (WML-OR146, or a Further Licence ) and with the proposals detailed on plan Brightwell Manor: Impact Plan for great crested newt District Licensing (Version 3) , dated 21st December 2023. Reason: In order to ensure that adverse impacts on great crested newts are adequately mitigated and to ensure that site works are delivered in full compliance with the organisational licence (WML-OR146, or a Further Licence ), section 15 of the National Planning Policy Framework, Circular 06/2005 and the Natural Environment and Rural Communities Act 2006 and Policy ENV2 of the South Oxfordshire Local Plan 2035

No development hereby permitted shall take place except in accordance with Part 1 of the Great Crested Newt Mitigation Principles, as set out in the District Licence WML-OR146 (or a Further Licence ), and in addition in compliance with the following: - Works which will affect likely newt hibernacula may only be undertaken during the active period for amphibians. Reason: In order to ensure that adverse impacts on great crested newts are adequately mitigated and to ensure that site works are delivered in full compliance with the Organisational Licence (WML-OR146, or a Further Licence ), section 15 of the National Planning Policy Framework, Circular 06/2005 and the Natural Environment and Rural Communities Act 2006 and Policy ENV2 of the South Oxfordshire Local Plan 2035.

The development hereby permitted shall be carried out in accord with the Great Crested Newt Method Statement (Ecology by Design, dated 31 October 2023) and with Recommendations R4 and R5 of the EcIA report (measures to protect nesting birds and mammals during construction). In the event that the provisions of the Great Crested Newt Method Statement conflict with any aspect of the NatureSpace great crested newt mitigation principles, the Nature Space document will carry the greater weight . Reason: In order to ensure that adverse impacts on great crested newts are adequately mitigated and to ensure that site works are delivered in full compliance with the Organisational Licence (WML-OR146, or a Further Licence ), Policy ENV2 of the South Oxfordshire Local Plan, section 15 of the National Planning Policy Framework, Circular 06/2005 and the Natural Environment and Rural Communities Act 2006

Prior to any works starting on site, a lighting strategy for bats shall be submitted to and approved in writing by the Local Planning Authority. The strategy shall: a) identify those areas/features on site that are particularly sensitive for bats and that are likely to cause disturbance in or around their breeding sites or resting places or along important routes used to access key areas of their territory, for example for foraging; and b) show how and where external lighting will be installed (through provision of appropriate lighting contour plans and technical specifications) so that it can be clearly demonstrated that areas to be lit will not disturb or prevent bats using their territory or having access to their breeding sites or resting places. All external lighting shall be installed in accordance with the specifications and locations set out in the strategy. Under no circumstances should any other external lighting be installed without the prior consent from the local planning authority. Reason: to avoid impacts on bats from insensitive external lighting in line with Policy ENV2 of the South Oxfordshire Local Plan

Prior to the commencement of the development hereby approved, full details (specification, height, position, orientation, etc.) of the faunal enhancements (bat box, bird box, bee brick, insect nest box) referred to in Recommendation R6 of the EcIA report shall be submitted to and approved in writing by the local planning authority. Thereafter, the development shall be implemented in accordance with those details. All faunal enhancements shall be provided onsite prior to first use. Reason: To secure ecological enhancements onsite, in accordance with Policy ENV3 of the South Oxfordshire Local Plan and paragraphs 180 and 186 of the NPPF.

Structural details for any alterations within the C17 section of the building such as floor construction, wall extensions or removal of the oak post shall be submitted and approved in writing by the Local Planning Authority prior to those areas of work commencing. Reason: To safeguard the special architectural or historic interest of the listed building in accordance with Policy ENV7 of the South Oxfordshire Local Plan 2035.

The tree protection details as shown on the approved arboricultural reports and Tree Protection Plans (Heritage Tree Services January 2024/HTS-TPP01A,02A,03A) shall be put in place prior to any on site works including demolition and thereafter retained in situ for the duration of development. Reason: To safeguard trees which are visually important in accordance with Policies ENV1, DES1, and DES2 of the South Oxfordshire Local Plan 2035.

That a scheme for the landscaping of the site, including the planting of four new specimen trees and two new native hedgerows (at the site frontage), shall be submitted to and approved in writing by the Local Planning Authority prior to the commencement of the development/development above slab level hereby permitted. These details shall include schedules of new trees and shrubs to be planted (noting species, plant sizes and numbers/densities), the identification of the existing trees and shrubs on the site to be retained (noting species, location and spread), any earth moving operations and finished levels/contours, and an implementation programme. The scheme shall be implemented prior to the first occupation or use of the development hereby approved and thereafter be maintained in accordance with the approved scheme. In the event of any of the trees or shrubs so planted dying or being seriously damaged or destroyed within 5 years of the completion of the development, a new tree or shrub or equivalent number of trees or shrubs, as the case may be, of a species first approved by the Local Planning Authority, shall be planted and properly maintained in a position or positions first approved in writing by the Local Planning Authority. Reason: To help to assimilate the development into its surroundings in accordance with Policies ENV1, DES1 and DES2 of the South Oxfordshire Local Plan 2035.
