Conditions / Refusal Reasons
The development to which this permission relates must be begun not later than the expiration of three years beginning with the date of this permission.
Reason: By virtue of Sections 91 to 95 of the Town and Country Planning Act 1990 as amended by section 51 of the Planning and Compulsory Purchase Act 2004.
That the development hereby approved shall be carried out in accordance with the details shown on the following approved plans, LOC 001 and BLO 001, except as controlled or modified by conditions of this permission.
Reason: To secure the proper planning of the area in accordance with Development Plan policies.
That the farm shop building shall only be open for trading during the period of 1 March and 31 December (inclusive) each year and shall not operate between 1 January and the last day of the month of February (inclusive), provided that produce grown at Rectory Farm is available for sale at all such times.
Reason: To ensure that inappropriate uses do not take place in this locality, in accordance with Policy EMP10 and CF1 of the adopted South Oxfordshire Local Plan 2035.
The cafe shall only operate when the Rectory Farm PYO and Farm Shop are open. For the avoidance of doubt, the cafe shall not open beyond either the opening hours or seasonal opening of the PYO and Farm Shop.
Reason: To ensure that the cafe supports the wider functioning of Rectory Farm PYO and Farm Shop, which forms part of the very special reasons for the new built development and change of use within the Green Belt in accordance with Policy STRAT6 of the South Oxfordshire Local Plan; 2035 and paragraphs 137, 138, 147, 148 and 149 of the National Planning Policy Framework.
That the farm shop building shall be used only for the sale of fruit, vegetables and other agricultural and horticultural produce and for no other purpose including any other purpose within Class E of the Town and Country Planning Use Class Order (as amended) or any provision equivalent to that class in any statutory instrument revoking and re-enacting that order with or without modification.
Reason: In order to protect area from inappropriate development within the Green Belt; and to ensure that the development has no significant adverse impact on the nearby village shop in accordance with Policies STRAT6, EMP10 and CF1 of the South Oxfordshire Local Plan; 2035 and paragraphs 137, 138, 147, 148 and 149 of the National Planning Policy Framework.
No less than 80% of the produce sold from the farm shop (as assessed by the annual turnover of produce sold therefrom) shall be sourced from local producers including Rectory Farm.
Reason: In order to protect the area from inappropriate development; and to ensure that the development has no significant adverse impact on the nearby village shop in accordance with Policies STRAT6, EMP10 and CF1 of the South Oxfordshire Local Plan; 2035 and paragraphs 137, 138, 147, 148 and 149 of the National Planning Policy Framework.
That retail sales shall only take place from within the building the subject of this planning application.
Reason: In the interest of visual amenities of the locality and to safeguard the openness of the Green Belt in accordance with Policies STRAT6, DES1, DES2, ENV1, EMP10 and CF1 of the South Oxfordshire Local Plan; 2035 and paragraphs 137, 138, 147, 148 and 149 of the National Planning Policy Framework.
No more than ten (10) tables shall be kept in the area designated for outdoor seating. They shall be no longer than 2 metres in length and no wider than 1.5 metres in width, including seating.
Reason: To protect the openness of the Green Belt and the reasons for including land within it; preventing encroachment of development into the countryside, as well as to protect the rural landscape character of the area, in accordance with policies in accordance with Policies STRAT6, DES1, DES2, ENV1 of the South Oxfordshire Local Plan; 2035 and paragraphs 137, 138, 147, 148 and 149 of the National Planning Policy Framework.
The tables situated in the outdoor seating area shall be afforded shade only by a single parasol/ umbrella each. The parasols/ umbrellas shall not exceed 3.5 metres in width.
Reason: To protect the openness of the Green Belt and the reasons for including land within it; preventing encroachment of development into the countryside, as well as to protect the rural landscape character of the area, in accordance with policies in accordance with Policies STRAT6, DES1, DES2, ENV1 of the South Oxfordshire Local Plan; 2035 and paragraphs 137, 138, 147, 148 and 149 of the National Planning Policy Framework.
Other than when the cafe is open no items or chattels other than the tables, chairs and parasols identified in Condition 8 shall be placed or kept in the area designated for outdoor seating.
Reason: To protect the openness of the Green Belt and the reasons for including land within it; preventing encroachment of development into the countryside, as well as to protect the rural landscape character of the area, in accordance with policies in accordance with Policies STRAT6, DES1, DES2, ENV1 of the South Oxfordshire Local Plan; 2035 and paragraphs 137, 138, 147, 148 and 149 of the National Planning Policy Framework.
The operation of the cafe shall be within the Class E(b) of the Use Classes Order (for the sale of food and drink for consumption on the premises of Rectory Farm). No food sold from the cafe shall be marketed or pre-packaged for consumption off the premises of Rectory Farm
Reason: To prevent the sale of general groceries and delicatessen products which would create direct competition with the village shop, and to avoid consequential detriment impact on the viability of the village shop, an essential community facility. In accordance with policies EMP10 and CF1 of the South Oxfordshire Local Plan 2035.
During the season when the cafe is closed as required by condition 3, the outdoor items shall be removed from the area designated for outdoor seating and stored indoors
