Conditions / Refusal Reasons
The proposed development would introduce a large-scale science and innovation park into a rural area which is not allocated for development and is outside of any of the district's settlements. The proposal therefore fails to accord with the strategy set out in the development plan and would not contribute towards achieving sustainable patterns of development. As such, the proposed development is contrary to policies STRAT1, STRAT2, STRAT4 and EMP1 of the South Oxfordshire Local Plan 2035.
The existing golf course contributes to the health and well-being of visitors and residents. The proposed development would be on land that forms part of the golf course and would result in the loss of land used for sports and recreation. No justification has been provided to show that the land is surplus to requirements. As such, the proposal is contrary to policies CF1 and CF4 of the South Oxfordshire Local Plan 2035.
The proposal represents inappropriate development in the Green Belt, would significantly reduce both spatial and visual aspects of Green Belt openness, and would undermine the purposes that the Green Belt serves. The Local Planning Authority does not consider the case put forward by the applicant to constitute very special circumstances sufficient to outweigh the harm by reason of inappropriateness and the substantial harm that this development would have on the openness of this part of the Green Belt. As such, the proposal is contrary to policy STRAT6 of the South Oxfordshire Local Plan 2035.
Due to the location of the site, and the lack of surrounding active travel infrastructure, the proposed development would not be accessible by walking, wheeling and cycling. Given the very poor active travel connectivity, future users of the development would be likely to be reliant on the private car, which would have a direct bearing on users' health, lifestyles, and social inclusivity. The proposal conflicts with the Local Transport and Connectivity Plan, which seeks to prioritise active travel and reduce vehicle trips along the highway network, and is contrary to policies TRANS2, TRANS4, TRANS5 and STRAT4 of the South Oxfordshire Local Plan 2035.
Insufficient information has been submitted to demonstrate that the proposed development would be served by an access that would be safe and convenient for all users of the highway network. As such, it has not been possible to assess whether the proposal would have an adverse impact on highway safety, contrary to policies TRANS2, TRANS4, TRANS5 and STRAT4 of the South Oxfordshire Local Plan 2035.
The application fails to properly assess the traffic impacts of the proposed development and the impact of the development along the highway network has not been assessed in accordance with the "Decide and Provide" approach as required by the Local Transport and Connectivity Plan. As such it is not possible to make an informed and reasoned decision on the traffic impacts of the development and the need for mitigation. The proposal is therefore contrary to policies TRANS4 and TRANS5 of the South Oxfordshire Local Plan 2035.
The proposed large-scale science and innovation park would be incompatible with the local landscape and open character of the area. The proposal would be inappropriate in the rural setting and would result in significant adverse effects on the landscape character and views. As such the proposal is contrary to policies ENV1, DES1 and DES2 of the South Oxfordshire Local Plan 2035.
The proposed development would result in the loss, deterioration and harm to priority habitats and species, legally protected species, and a Conservation Target Area. There is no compelling justification for a large-scale science and innovation park to be located on this site that would outweigh the harm to these ecological assets. As such, the proposed development is contrary to policies ENV2 and ENV4 of the South Oxfordshire Local Plan 2035.
The proposed development would result in a net loss of biodiversity and the alternatives available which avoid impacts on biodiversity have not been fully explored. The proposal would therefore fail to conserve, restore and enhance biodiversity in the district contrary to policies ENV3 and DES1 of the South Oxfordshire Local Plan 2035.
The application fails to demonstrate that the quantum of development proposed can be accommodated on site without an adverse impact on the health and longevity of trees that are of landscape value. As such, the proposal is contrary to policy ENV1 of the South Oxfordshire Local Plan 2035.
The proposed development would be within the setting of several designated heritage assets. Due to the effect on their setting, the proposal would harm the significance of Waterstock Conservation Area and Listed Buildings within the Conservation Area, plus the Grade II* Waterperry House. There is no clear and convincing justification for the development and the public benefits of the scheme would not outweigh the identified harm. As such, the proposed is contrary to policies ENV6, ENV7 and ENV8 of the South Oxfordshire Local Plan 2035.
Insufficient information has been submitted to make an informed and reasoned decision on the impact of the development on archaeology. Based on the information submitted, it is not possible to define the character and extent of archaeological remains at the application site or identify potential options for minimising or avoiding damage to archaeology. As such, the proposal is contrary to policies ENV6 and ENV9 of the South Oxfordshire Local Plan 2035.
Insufficient information has been submitted to make an informed and reasoned decision on the impact of the development on human health and the natural environment in respect of contaminated land. Without an appropriate assessment, it is not possible to define the character and full extent of any contamination or identify potential options for mitigation and remediation. As such, the proposal is contrary to policies ENV11 and STRAT4 of the South Oxfordshire Local Plan 2035.
The Flood Risk Assessment has not taken into account the impacts of climate change and does not adequately assess flood risk across the site. It has therefore not been possible to determine whether the risk of flooding has been minimised through directing new development to areas with the least probability of flooding. As such, the proposal is contrary to policy EP4 of the South Oxfordshire Local Plan 2035.
Insufficient information has been submitted to demonstrate that the proposed development would be served by an appropriate foul and surface water drainage strategy. As such, the proposal is contrary to policies INF4, EP4 and STRAT4 of the South Oxfordshire Local Plan 2035.
Insufficient information has been submitted to make an informed and reasoned decision on the impact of the development on the amenity of neighbouring uses in terms of noise impact. As such, the proposal is contrary to policy DES6 of the South Oxfordshire Local Plan 2035.
In the absence of a completed Section 106 legal agreement, the proposed development fails to secure infrastructure necessary to meet the needs of the development. As such, the proposal is contrary to policies INF1, TRANS4, TRANS5 and STRAT4 of the South Oxfordshire Local Plan 2035.
