Variation of condition 2 (approved plans) on application P22/S0949/FUL - relocation of CO2 tank and storage cabin and the relocation of the disabled parking bays (As amplified by additional information received 19 June 2023).
(Construction and operation of a cylinder depot including the widening of the main site access, creation of a hardstanding, construction of a garage, offices and three liquid gas storage tanks, additional helium compressor, new weighbridge and island with fuel dispenser, steel frame canopy for sorting and storage of cylinders, HGV parking bays, internal access road and demolition of the sales building to create additional ancillary staff car parking).
Conditions / Refusal Reasons
The development to which this permission relates must be begun not later than 19 December 2025.
Reason: By virtue of Sections 91 to 95 of the Town and Country Planning Act 1990 as amended by section 51 of the Planning and Compulsory Purchase Act 2004.
That the development hereby approved shall be carried out in accordance with the details shown on the following approved plans, GA DIDCOT EN 21 3433 001 Rev 1, and the following plans approved under application reference P22/S0949/FUL;
CMP-001, 4 rev 1, 001, 2278B-3, 2278B-1 and CMP-001
except as controlled or modified by conditions of this permission.
Reason: To secure the proper planning of the area in accordance with Development Plan policies.
That, unless otherwise agreed in writing the development shall be carried out as per the tree protection details approved under application reference P23/S0079/DIS in letter dated 1 February 2023.
Reason: To safeguard trees which are visually important in accordance with Policies ENV1, DES1, and DES2 of the South Oxfordshire Local Plan 2035.
That, unless otherwise agreed in writing the development shall be carried out as per the cycle parking facility details approved under application reference P23/S0079/DIS in letter dated 1 February 2023.
Reason: To encourage the use of cycles as a means of transport in accordance with Policy TRANS5 of the South Oxfordshire Local Plan 2035.
That, unless otherwise agreed in writing the development shall be carried out as per the construction traffic management plan dated December 2022 approved under application reference P23/S0079/DIS in letter dated 1 February 2023.
Reason: In the interests of highway safety and to mitigate the impact of construction vehicles on the surrounding highway network, road infrastructure and local residents, particularly at morning and afternoon peak traffic times and in accordance with Policy TRANS5 of the South Oxfordshire Local Plan 2035.
Prior to first use of the cylinder depot, a record of the installed SuDS and site wide drainage scheme shall be submitted to and approved in writing by the Local Planning Authority for deposit with the Lead Local Flood Authority Asset Register. The details shall include:
· As built plans in both .pdf and .shp file format;
· Photographs to document each key stage of the drainage system when installed on site;
· Photographs to document the completed installation of the drainage structures on site;
· The name and contact details of any appointed management company information.
Reason: To ensure the proper provision of surface water drainage and to ensure flooding is not exacerbated in the locality in accordance with Policy EP4 of the South Oxfordshire Local Plan 2035.
Prior to the first use of the cylinder depot hereby approved, the parking and turning areas shall be provided in accordance with the approved plans and shall be constructed, laid out, surfaced, drained and completed to be compliant with sustainable drainage (SuDS) principles, and shall be retained unobstructed except for the parking of vehicles associated with the development at all times.
Reason: To provided adequate car parking, in the interest of highway safety and to avoid localised flooding. in accordance with Policy TRANS5 of the South Oxfordshire Local Plan 2035.
The exterior of the development hereby permitted shall only be constructed in the materials specified on the plans/supporting documents hereby approved or in materials which shall previously have been approved in writing by the Local Planning Authority.
Reason: In the interests of the visual appearance of the development in accordance with Policies DES1 and DES2 of the South Oxfordshire Local Plan 2035.
The development hereby approved shall be implemented in strict accordance with all of the measures stated in section 5 of the supporting Ecological Impact Assessment Report (SLR, October 2022). 4 Bird boxes and 2 bat boxes shall be installed in suitable locations, informed by the project ecologist, prior to the first use of the development.
Reason: To minimise the ecological impacts of development, in accordance with Policies ENV2 and ENV3 of the SOLP, and paragraphs 174 and 180 of the NPPF.
No development hereby permitted shall take place except in accordance with the terms and conditions of the Council's organisational licence (WML-OR112) and with the proposals detailed on plan "Air Products: Impact Plan for great crested newt District Licensing (Version 2)", dated 14th September 2022.
Reason: In order to ensure that adverse impacts on great crested newts are adequately mitigated and to ensure that site works are delivered in full compliance with the organisational licence WML OR112 and in accordance with Policy ENV2 of the South Oxfordshire Local Plan 2035.
The developer shall confirm in writing to the Local Planning Authority the presence of any unsuspected contamination encountered during the development. In the event of any contamination to the land and/or water being encountered, no development shall continue until a programme of investigation and/or remedial works to include methods of monitoring and certification of such works undertaken. Where land contamination investigation/remedial works are required this must be carried out by a competent person in accordance with current government and Environment Agency Guidance and Approved Codes of Practice such as Land Contamination: Risk Management 2020 and BS10175:2011 +A2:2017 'Investigation of potentially contaminated sites' and submitted to and approved in writing by the local planning authority.
Reason: To ensure that any ground, water and associated gas contamination is identified and adequately addressed to ensure the safety of the development, the environment and to ensure the site is suitable for the proposed use in accordance with Policy ENV11 of the South Oxfordshire Local Plan 2035.
