Description
Removal / demolition of existing community shop. Erection of a community building to provide a new shop, cafe and hub for the community. Alterations to existing car park and provision of overflow parking area (updated arboricultural report and BREEAM review submitted 25 July 2023).
Conditions / Refusal Reasons
The development to which this permission relates must be begun not later than the expiration of three years beginning with the date of this permission.
Reason: By virtue of Sections 91 to 95 of the Town and Country Planning Act 1990 as amended by section 51 of the Planning and Compulsory Purchase Act 2004.
That the development hereby approved shall be carried out in accordance with the details shown on the following approved plans, 2022-002.1, 2022-002, 2022-004, 2022-005, 2022-006, 2022-003, 2022-001 and 2022-007, except as controlled or modified by conditions of this permission.
Reason: To secure the proper planning of the area in accordance with Development Plan policies.
No development shall commence until a scheme for the landscaping of the site, including the planting of live trees and shrubs, has been submitted to and approved in writing by the Local Planning Authority. The approved scheme shall be implemented prior to the first occupation or use of the development hereby approved and thereafter be maintained in accordance with the approved scheme. In the event any of the trees or shrubs planted die, or are seriously damaged or destroyed within 5 years of the completion of the development, a new tree or shrub or equivalent number of trees or shrubs, of a species first approved by the Local Planning Authority, shall be planted and properly maintained in a position or positions first approved in writing by the Local Planning Authority.
Reason: To help to assimilate the development into its surroundings in accordance with policies ENV1, DES1 and DES2 of the South Oxfordshire Local Plan 2035.
No works shall commence until the approved tree protection measures identified within the Arboricultural Impact Assessment and Method Statement Report Date: 22 July 2023 (Ref HBD2020IAMSR2) and shown on the Tree Protection Plan (Plan HB1) have been implemented. Thereafter the tree protection measures shall be retained in situ in accordance with the approved scheme for the duration of development.
Reason: To protect the existing trees in accordance with policies ENV1, DES1 and DES2 of the South Oxfordshire Local Plan 2035.
No development shall commence until a full surface water drainage scheme, including details of the size, position and construction of drainage works, has been submitted to, and approved in writing by, the Local Planning Authority. The drainage scheme shall be designed to accommodate a 1 in 100 year storm + 40% CC and shall be implemented in accordance with the approved details prior to the occupation of the development hereby approved.
Reason: To ensure the proper provision of surface water drainage and to ensure flooding is not exacerbated in the locality in accordance with policy EP4 of the South Oxfordshire Local Plan 2035.
No development above slab level shall occur until details of cycle parking facilities have been submitted to and approved in writing by the Local Planning Authority. Thereafter the approved cycle parking facilities shall be installed prior to the first use and occupation of the development.
Reason: To encourage the use of cycles as a means of transport in accordance with policy TRANS5 of the South Oxfordshire Local Plan 2035.
Prior to the first occupation of the development, hereby approved, the parking and turning areas shall be provided in accordance with drawing no. 2022/002 REV A, and shall be constructed, laid out, surfaced, drained and completed to be compliant with sustainable drainage (SuDS) principles, and shall be retained unobstructed except for the parking of vehicles associated with the development at all times.
Reason: In the interests of highway safety and in accordance with policy TRANS5 of the South Oxfordshire Local Plan 2035.
The development hereby approved shall be constructed and finished in line with the BREEAM review prepared by South Stoke Parish Council. Thereafter, the building shall not be occupied until all measures contained within the document have been incorporated into the completed building.
Reason: To ensure high standards of sustainable design and construction in accordance with policy DES10 of the South Oxfordshire Local Plan 2035.
Prior to first use and occupation of the community building an Electric Vehicle Charging Point must be installed in the car park.
Reason: To ensure sustainable forms of transport are provided in accordance with policy TRANS5 of the South Oxfordshire Local Plan 2035.
Within one month of the first use and occupation of the community building the existing containers housing the existing shop, storage and office must be removed and cleared from the site.
Reason: In the interests of the visual appearance of the development in accordance with Policies DES1 and DES2 of the South Oxfordshire Local Plan 2035.
All plant, machinery and equipment to be used shall be installed, maintained and operated so as to ensure that the rating noise level from the equipment does not exceed the background noise level at the boundary of the premises. Measurement and rating of noise for the purposes of this condition shall be in accordance with BS4142 (2014) 'Method for rating industrial and commercial sound'. The measurement location shall be 1 metre from the facade of the nearest noise sensitive receptor.
In the event of unacceptable noise or vibration being caused by the installed plant, machinery and equipment, the applicant or persons responsible shall investigate and undertake works to resolve the problem to the satisfaction of the local planning authority.
Reason: To protect the occupants of nearby residential properties from loss of amenity due to noise disturbance and in accordance with policy ENV12 of the South Oxfordshire Local Plan 2035.
The exterior of the development hereby permitted shall only be constructed in the materials specified on the plans/supporting documents hereby approved or in materials which shall previously have been approved in writing by the Local Planning Authority.
Reason: In the interests of the visual appearance of the development in accordance with Policies DES1 and DES2 of the South Oxfordshire Local Plan 2035.
As and when the overflow car park is in operation a 1800mm high barrier should be erected at the edge of the overflow car park to protect vehicles from ball strike
Reason: To ensure protection from ball strike for vehicles parked in the overflow car park and to accord with policy CF4 of the South Oxfordshire Local Plan 2035.
