Conditions / Refusal Reasons
The development to which this permission relates must be begun not later than 4 May 2023. Reason: By virtue of Sections 91 to 95 of the Town and Country Planning Act 1990 as amended by section 51 of the Planning and Compulsory Purchase Act 2004.

That the development shall, unless otherwise agreed in writing with the Local Planning Authority (LPA), be carried out in phases as follows: 1) provision of a hard surface as shown on drawing 6151_prep; and 2) Construction and development of a dwelling and related works; The developer shall, before commencing each phase, notify the LPA of the date of the commencement of each phase by exchange of letter/email. Reason: To allow for flexibility delivering the scheme.

That the development hereby approved shall be carried out in accordance with the details shown on the following approved plans, 6151_vis July 2017 - pedestrian visibility splay 6151_ prep block plan PE 2 - East elevation PF 1 - Ground floor proposed PA 01 - Location Plan PE 4 - North East elevation proposed PE 3 -North east section proposed PRP1- Proposed roof plan PE 1 -South elevation proposed PE 5 - West elevation except as controlled or modified by conditions of this permission. Reason: To secure the proper planning of the area in accordance with Development Plan policies.

Prior to the commencement of development, other than the hardsurface works shown on drawing 6151_prep, no development above slab level shall take place until a photographic schedule of all materials to be used in the external construction and finishes of the development hereby permitted has been submitted to and approved in writing by the Local Planning Authority. Reason: In the interests of the visual appearance of the development in accordance with Policies DES1 and DES2 of the South Oxfordshire Local Plan 2035.

Notwithstanding the provisions of the Town and Country Planning (General Permitted Development) Order 2015 (or any Order revoking or re-enacting that Order), the enlargement, improvement or other alteration of any dwellinghouse as described in Schedule 2, Part 1, Class A of the Order shall not be undertaken without obtaining planning permission from the Local Planning Authority. Reason: To safeguard the amenities of the occupiers of the adjoining properties and the character of the area in accordance with Policies DES1, DES2 and DES6 of the South Oxfordshire Local Plan 2035.

Notwithstanding the provisions of the Town and Country Planning (General Permitted Development) Order 2015 (or any Order revoking or re-enacting that Order) the provision within the curtilage of the dwelling of any building, enclosure or swimming pool as described in Schedule 2, Part 1, Class E of the Order shall not be undertaken without obtaining planning permission from the Local Planning Authority. Reason: To safeguard the amenities of the occupiers of the adjoining properties and the character of the area in accordance with Policies DES1, DES2 and DES6 of the South Oxfordshire Local Plan 2035.

Prior to first occupation of the dwelling hereby approved, the existing means of access onto Sand Path shall be improved and laid out and constructed strictly in accordance with the local highway authority's specifications and all ancillary works specified shall be undertaken. Reason: In the interest of highway safety in accordance with Policy T1 of the South Oxfordshire Local Plan 2011.

The vision splays shown on the approved plan 6151_vis July 2017 shall not be obstructed by any object, structure, planting or other material with a height exceeding or growing above 0.9 metres as measured from carriageway level. Reason: In the interest of highway safety in accordance with Policy TRANS5 of the South Oxfordshire Local Plan 2035.

Prior to the first occupation of the dwelling hereby approved, the parking and turning areas shall be provided in accordance with the approved plan annotated as "proposed ground floor plan" ) and shall be constructed, laid out, surfaced, drained and completed to be compliant with sustainable drainage (SuDS) principles, and shall be retained unobstructed except for the parking of vehicles associated with the development at all times. Reason: In the interests of highway safety and in accordance with Policy TRANS5 of the South Oxfordshire Local Plan 2035.

The Construction Traffic Management Plan which was submitted on 20 April 2020 (reference April 2020 VERSION 1) shall be implemented prior to any works being carried out the site, and shall be maintained throughout the course of the development Reason: In the interests of highway safety and to mitigate the impact of construction vehicles on the surrounding highway network, road infrastructure and local residents, particularly at morning and afternoon peak traffic times and in accordance with Policy TRANS5 of the South Oxfordshire Local Plan 2035.

Prior to the commencement of development, other than the hardsurface works shown on drawing 6151_prep, a full surface water drainage scheme, including details of the size, position and construction of drainage works, shall be submitted to, and approved in writing by, the Local Planning Authority. The drainage scheme shall be designed to accommodate a 1 in 10 year storm + 40% CC and will be implemented in accordance with the approved details prior to the occupation of the dwelling hereby approved. Reason: To ensure the proper provision of surface water drainage and to ensure flooding is not exacerbated in the locality

Prior to the commencement of development, other than the hardsurface works shown on drawing 6151_prep, a full foul water drainage scheme shall be submitted to and approved in writing by the Local Planning Authority. The scheme shall include details of the size, position and construction of the drainage scheme, all coupled with calculations to evidence this. The scheme will be implemented in accordance with the approved details prior to the occupation of the dwelling hereby approved. Reason: To ensure the proper provision of foul water drainage and to ensure flooding and pollution is not exacerbated in the locality in accordance with policy EP4 of the South Oxfordshire Local Plan 2035.
