Conditions / Refusal Reasons
The application site is not allocated for development in either the South Oxfordshire Local Plan 2035, or the Chalgrove Neighbourhood Plan (CNP) (2018) and lies outside the built-up area of the settlement. The proposed development does not accord with the spatial strategy for housing within the district as set out in policies STRAT1 and H1 of the South Oxfordshire Local Plan 2035, and would also be contrary to policy C1 of the Chalgrove Neighbourhood Plan.
The proposed development would result in less than substantial harm to the significance of the Registered Battlefield. This harm is not outweighed by any public benefits. Therefore the proposed development would be contrary to policies ENV6 and ENV10 of the South Oxfordshire Local Plan 2035 and paras. 205 and 208 of the NPPF.
The proposed development would breach the strong established edge of Chalgrove, introducing urban development into the open countryside and thereby causing harm to the rural landscape and open countryside. Views from the B480 towards the Chilterns National Landscape would also be harmed. Accordingly, the proposed development would conflict with policy ENV1 of the South Oxfordshire Local Plan 2035, policy C1 of the Chalgrove Neighbourhood Plan as well as paras. 135e, and 180 of the NPPF.
The proposed development would result in the loss of best and most versatile agricultural land for which there is no justification at this time. The proposed development is therefore contrary policy DES7 of the South Oxfordshire Local Plan 2035 and para. 180 of the NPPF.
The proposed development would be located directly at the end of the existing runway, currently operated by Martin-Baker Aircraft Company Ltd, creating an unacceptable degree of noise and disturbance for the future occupiers of the development, detrimental to their living conditions contrary to policies DES6 and ENV11 (1 and 2) of the South Oxfordshire Local Plan 2035 and paras, 180e and 191b of the NPPF.
Being located directly at the end of the existing runway, currently operated by Martin Baker Aircraft Company Ltd future occupiers would be put at an unacceptable safety risk in conflict with policies DES1, DES6 and ENV12 of the South Oxfordshire Local Plan 2035 which seeks to ensure that development proposals do not result in significant adverse impacts on human health. Furthermore, the proposal would conflict with para. 101, 131 and 135 of the NPPF.
In the light of current operations at Chalgrove Airfield, future residents would be likely to result in complaints by future occupiers of the proposed development in relation to noise and disturbance which would potentially have a detrimental impact on the continued operations Martin-Baker Aircraft Company Ltd contrary to para. 193 of the NPPF.
In the absence of a completed Section 106 legal agreement, the proposal fails to secure affordable housing to meet the of the development. As such, the development would be contrary to policies H9 and H11 of the South Oxfordshire Local Plan 2035.
In the absence of a completed Section 106 agreement the proposal fails to secure infrastructure to meet the needs of the development. As such the development is contrary to policies INF1 and CF5 of the South Oxfordshire Local Plan 2035.
