Conditions / Refusal Reasons
That the development hereby approved shall be carried out in accordance with the details shown on the following approved plans, 1238-1 S73-01, 1238-1 S73-02 and 1238-1 S73-03, and the following drawings approved under application reference P20/S826/FUL; PL-01A, PL-02A, PL-04A, PL-05, PL-06, PL-07A, PL-08A, PL-09 except as controlled or modified by conditions of this permission. Reason: To secure the proper planning of the area in accordance with Development Plan policies. Related application(s): P23/S0853/DIS

That, unless otherwise agreed in writing by the Local Planning Authority, the development hereby approved shall be carried out in accordance with the tree protection measures approved under application P21/S1087/DIS in decision letter dated 11 May 2021 and these measures shall be kept in place throughout the entire course of development. Reason: To safeguard trees which are visually important in accordance with Policy ENV1 of the South Oxfordshire Local Plan 2035.

That, unless otherwise agreed in writing by the local planning authority, the surface water drainage scheme shall be carried out in accordance with the details approved under application P21/S1087/DIS in decision letter dated 11 May 2021. The drainage scheme shall be implemented as approved prior to the occupation of the dwelling. Reason: To ensure the proper provision of surface water drainage and to ensure flooding is not exacerbated in the locality in accordance with Policies EP4 and INF4 of the South Oxfordshire Local Plan 2035.

That, unless otherwise agreed in writing by the local planning authority, the foul water drainage scheme shall be carried out in accordance with the details approved under application P21/S1087/DIS in decision letter dated 11 May 2021. The drainage scheme shall be implemented as approved prior to the occupation of the dwelling. Reason: To prevent pollution in accordance with Policies ENV11, EP4 an INF4 of the South Oxfordshire Local Plan 2035. Note: We will not accept a Septic Tank and thus, a Package Treatment Plant fabricated to BS EN 12566 and subsequent Drainage Field to BS6297 will need to be investigated.

The Holiday Lets, storage barn and the land surrounding those buildings identified as 'Phase 1' (as shown on drawing S73-02) shall not be occupied until any previously approved remediation strategy covering that area has been carried out in full and a validation report confirming completion of these works has been submitted to and approved in writing by the Local Planning Authority. In addition, the Dwelling and land surrounding it identified as 'Phase 2' (as shown on drawing S73-02) shall not be occupied until any previously approved remediation strategy covering that area has been carried out in full and a validation report confirming completion of these works has been submitted to and approved in writing by the Local Planning Authority. Reason: To ensure that any ground, water and associated gas contamination is identified and adequately addressed to ensure the safety of the development, the environment and to ensure the site is suitable for the proposed use in accordance with Policy EP11 of the South Oxfordshire Local Plan 2035.

Prior to the first occupation of any part of the development hereby permitted the proposed means of access for that part onto the Icknield Way is to be formed and laid out and constructed strictly in accordance with the local highway authority's specifications and all ancillary works specified shall be undertaken. Reason: In the interest of highway safety in accordance with Policy TRANS5 of the South Oxfordshire Local Plan 2035.

Prior to the first occupation of any part of the development hereby approved, the parking and turning areas for that part shall be provided in accordance with the approved plan S73-01 and shall be constructed, laid out, surfaced, drained and completed to be compliant with sustainable drainage (SuDS) principles, and shall be retained unobstructed except for the parking of vehicles associated with the development at all times. Reason: In the interest of highway safety in accordance with Policy TRANS5 of the South Oxfordshire Local Plan 2035.

The vision splays shown on the approved plan S73-01 shall not be obstructed by any object, structure, planting or other material with a height exceeding or growing above 0.9 metres as measured from carriageway level. Reason: In the interest of highway safety in accordance with Policy TRANS5 of the South Oxfordshire Local Plan 2035.

The proposed storage facility should remain ancillary to the main dwelling as per the comments made within the Transport Statement: "Building E will be redeveloped to act as a personal storage facility for the owners of the property." Reason: In the interest of highway safety in accordance with Policy TRANS5 of the South Oxfordshire Local Plan 2035.

The exterior of the development hereby permitted shall only be constructed in the materials specified on the plans hereby approved or in materials which shall previously have been approved in writing by the Local Planning Authority. Reason: In the interests of the visual appearance of the development in accordance with Policies ENV1, DES1 and DES2 of the South Oxfordshire Local Plan 2035.

The landscaping scheme as shown on the approved plan S73-01 shall be implemented prior to the first occupation or use of the approved development and thereafter be maintained in accordance with the approved scheme. In the event of any of the trees or shrubs so planted dying or being seriously damaged or destroyed within 5 years of the completion of the development, a new tree or shrub or equivalent number of trees or shrubs, as the case may be, of a species first approved by the Local Planning Authority, shall be planted and properly maintained in a position or positions first approved in writing by the Local Planning Authority. Reason: To help to assimilate the development into its surroundings in accordance with Policies ENV1, DES1 and DES2 of the South Oxfordshire Local Plan 2035.

The development hereby approved shall be implemented in accordance with all of the recommendations made in section 5 and details shown on page 27 of the supporting Initial Ecology Appraisal (James Johnston Ecology, 18/02/2020, Ref: JJ706.3). Reason: To secure net gains for biodiversity, in accordance with Policies ENV2 and ENV3 of the South Oxfordshire Local Plan 2035

That units F and G shown on drawing no S73-01 shall only be used for holiday accommodation purposes and not for any other residential use falling within use class C3 of the Schedule to the Town and Country Planning (Use Classes) Order 1987 (as amended), or any Statutory Instrument revoking or re-enacting that Order with or without modification. For the avoidance of doubt 'any other residential use' includes a person's or persons' main residence, or a unit of accommodation that is occupied on a permanent basis by the same person or persons. Reason: To ensure the approved residential units are not occupied on a permanent basis in this unsustainable rural location in accordance with the aims of policies STRAT1, H1 and TRANS5 of the South Oxfordshire Local Plan 2035.

Notwithstanding the provisions of the Town and Country Planning (General Permitted Development) Order 2015 (or any Order revoking or re-enacting that Order), the enlargement, improvement or other alteration of any dwellinghouse or buildings etc incidental to the enjoyment of a dwellinghouse as described in Schedule 2, Part 1, Class A and E of the Order shall not be undertaken without obtaining planning permission from the Local Planning Authority. Reason: To ensure the Local Planning Authority retains control over any future development as specified in the condition in the interests of amenity and to protect the special landscape of the Chilterns Area of Outstanding Natural Beauty and in accordance with Policies EN1, DES1 and DES2 of the South Oxfordshire Local Plan 2035.
