Conditions / Refusal Reasons
The proposed development fails to accord with the strategy set out in the development plan as the application site is not a site allocated for development. The site is outside of the development boundary of the village of Chinnor and the proposal would not constitute infill development. As such, the proposed development is contrary to policies STRAT1, H1 and H4 of the South Oxfordshire Local Plan 2035 and Policy CH H7 of the Chinnor Review Neighbourhood Plan 2021.

The proposed development would protrude into open countryside to the north of Chinnor, in an open and widely visible location. There would be adverse effects on the open rural character of the landscape and important views to the Chilterns escarpment and countryside, adversely affecting the setting of the Chilterns AONB and the setting of Chinnor. The development would harm the local landscape character and also to the visual separation between the villages to the north of Emmington and Sydenham towards Chinnor. The development is contrary to local plan policies ENV1, DES1 and DES2 of the South Oxfordshire Local Plan 2035, the NPPF paragraph and policy DP4 of the Chilterns AONB Management Plan.

The site is within a location that has experienced high groundwater and there are historic records of flooding associated with foul water flows from drainage infrastructure to nearby properties, Thames Water have advised that this is a groundwater affected drainage system. By extending the foul network in an area at risk of high groundwater, there is an increased risk of groundwater entering the system due to a larger network. Inadequate consideration has been given to this risk of increased flooding in the Flood Risk Assessment, a sequential test has not been carried out and suitable mitigation has not been considered. The proposals is therefore contrary to the NPPF and Policy EP4 of the South Oxfordshire Local Plan 2035.

The proposed development would result in the loss of best and most versatile agricultural land. The application does not demonstrate that the development of this land is the most sustainable choice from reasonable alternatives as there could be areas of poorer quality land that would be preferable to develop instead of this very good quality land. The proposed development is therefore contrary to the NPPF and Policy DES7 of the South Oxfordshire Local Plan 2035.

Insufficient information has been submitted to make an informed and reasoned decision on the impact of the development on archaeology. Based on the information submitted, it is not possible to define the character and extent of archaeological remains at the application site or identify potential options for minimising or avoiding damage to archaeology. As such, the proposal is contrary to the NPPF and Policies ENV6 and ENV9 of the South Oxfordshire Local Plan 2035.

The development does not provide satisfactory links and connections in the form of an internal pedestrian link from Windmill Close and a controlled crossing across Thame Road. Without this pedestrian access and crossing there is poor accessibility and inadequate encouragement for pedestrian movements In addition much of the development is sited over 400m away from existing bus stops and the development does not propose bus stops closer to the site. The lack of this transport infrastructure results in an unsustainable development contrary to Policies DES1, TRANS2 and TRANS5 of the South Oxfordshire Local Plan 2035 and the Local County Transport Plan.

In the absence of a completed Section 106 legal agreement, the proposed development fails to secure affordable housing to meet the needs of the district. As such, the proposal is contrary to Policies H9 and H11 of the South Oxfordshire Local Plan 2035.

As such, the proposal is contrary to Policies INF1, TRANS4, TRANS5, EP3 and CF5 of the South Oxfordshire Local Plan 2035. Moreover, there is insufficient primary school capacity in Chinnor and the impact of the proposed development on education could not be suitably mitigated by the development.
