Conditions / Refusal Reasons
The development to which this permission relates must be begun not later than the expiration of three years beginning with the date of this permission. Reason: By virtue of Sections 91 to 95 of the Town and Country Planning Act 1990 as amended by section 51 of the Planning and Compulsory Purchase Act 2004.

That the development hereby approved shall be carried out in accordance with the details shown on the following approved plans, 21085-PP2010-B, 21085-PP2030-A, 21085-PP2011-B, 21085 PP2012, 21085 L001 A and 21085 SU001, except as controlled or modified by conditions of this permission. Reason: To secure the proper planning of the area in accordance with Development Plan policies.

Prior to the first use of the development hereby approved, the external parking and turning areas shall be provided in accordance with the approved plan 21085-PP2011-B and shall be constructed, laid out, surfaced, drained and completed to be compliant with sustainable drainage (SuDS) principles, and shall be retained unobstructed except for the parking of vehicles associated with the development at all times. Reason: To ensure the proper provision of surface water drainage in the area in accordance with Policy EP4 of the South Oxfordshire Local Plan 2035.

The exterior of the development hereby permitted shall only be constructed in the materials specified on the plans hereby approved or in materials which shall previously have been approved in writing by the Local Planning Authority. Reason: In the interests of the visual appearance of the development in accordance with Policies STRAT1, ENV1, DES1 and DES2 of the South Oxfordshire Local Plan 2035.

The tree protection details as set out in supporting documents Tree Survey Report, Impact Appraisal and Tree Protection Details report and shown on the Tree Protection Plan (Appendix 4 Revised February 2023) hereby approved, shall be put in place prior to any on site works including demolition and thereafter retained in situ for the duration of development. Reason: To safeguard trees which are visually important and contribute positively to the existing wildlife habitats at the site in accordance with Policies START, ENV1, ENV2, ENV3, DES1, and DES2 of the South Oxfordshire Local Plan 2035.

The development hereby approved shall be implemented strictly in accordance with all of the measures stated in the supporting Great Crested Newt Habitat Assessment and Mitigation Strategy (Windrush Ecology, April 2023). To discharge this condition, the developer shall document (photographically and otherwise) compliance with the approved mitigation strategy and submit evidence to the local planning authority for approval prior to first use of the development. Reason: To minimise the ecological impacts of development, in compliance with Policy ENV2 and paragraphs 174 and 180 of the NPPF.

Prior to the first use of the development hereby approved, details of a range of biodiversity enhancements (specification, position, height, orientation, etc.) to be implemented on site shall be submitted to and approved in writing by the local planning authority. For the avoidance of doubt, these features shall include a minimum of: one bat box, one bird box and one amphibian hibernacula. Thereafter, the development shall be implemented in accordance with the approved details and all enhancement measures provided onsite prior to first use. Reason: To secure the delivery of biodiversity enhancements onsite, in compliance with Policy ENV2 and paragraphs 174 and 180 of the NPPF.

Notwithstanding the provisions of the Town and Country Planning (General Permitted Development) Order 2015 (or any Order revoking or re-enacting that Order) the provision within the curtilage of the dwelling of any building, enclosure or swimming pool as described in Schedule 2, Part 1, Class E of the Order shall not be undertaken without obtaining planning permission from the Local Planning Authority. Reason: To safeguard the adjoining Ancient Woodland, the existing wildlife habitats and protected species across the site and the character of the area in accordance with Policies STRAT1, ENV1, ENV2, ENV3, DES1and DES2 of the South Oxfordshire Local Plan 2035.
