Conditions / Refusal Reasons
The application site is not allocated for development in the South Oxfordshire Local Plan 2035 or the Warborough and Shillingford Neighbourhood Plan 2018, nor is it within a location where development is acceptable and nor does it represent infill development. As such the development is contrary to the spatial strategy of the Council and policies STRAT1, H1, H8 and H16 of the South Oxfordshire Local Plan 2035, and policy H3 of the Warborough and Shillingford Neighbourhood Plan 2018 and the NPPF.
The development proposals would introduce a modern estate into an area of rural character at the edge of the village. The depth and density of the development would not respect the existing landscape character and the scale and form of the northern part of Warborough contrary to policies ENV1, DES1 and DES2 of the South Oxfordshire Local Plan 2035 and policy VC1 of the Warborough and Shillingford Neighbourhood Development Plan 2018.
The development would result in the loss and erosion of open space that would harm the significance of the Warborough Conservation Area and the non-designated heritage asset of 108 Thame Road contrary to the requirements of policies ENV6 and ENV8 of the South Oxfordshire Local Plan 2035 and the NPPF.
The market housing mix provides an imbalance of housing sizes, providing too many larger homes and insufficient smaller dwellings which will not assist in meeting the housing needs of the District. The proposal is therefore contrary to policy H11 of the South Oxfordshire Local Plan 2035 and policy H1 of the Wallingford and Shillingford Neighbourhood Development Plan 2018.
In the absence of an implemented 20mph zone on Thame Road, the proposed visibility splays are inadequate and detrimental to highway safety and therefore contrary to policy TRANS5 of the South Oxfordshire Local Plan 2035.
The development would lead to a significant net loss of biodiversity which is not outweighed by the benefit of 15 dwellings. The proposal is therefore contrary to Policies ENV3 and DES1 of the South Oxfordshire Local Plan 2035.
In the absence of a detailed soil assessment for the site, there is insufficient information to assess the impact of the loss of Grade 3 agricultural land. The development is therefore contrary to policy DES7 of the South Oxfordshire Local Plan 2035.
There is insufficient drainage information to confirm that the development proposal would not have an adverse impact upon flooding in the area. Therefore the development would be contrary to policies DES1 and EP4 of the South Oxfordshire Local Plan 2035.
In the absence of an archaeological field evaluation by a professionally qualified archaeological organisation the character and extent of archaeological remains within the application area cannot be ascertained. As such the development is contrary to policy ENV9 of the South Oxfordshire Local Plan 2035 and paragraph 194 of the NPPF.
In the absence of a completed Section 106 legal agreement, the proposal fails to secure affordable housing to meet housing need. As such, the development would be contrary to policies H9 and H11 of the South Oxfordshire Local Plan 2035 and the National Planning Policy Framework.
In the absence of a completed Section 106 legal agreement, the proposal fails to secure infrastructure required to meet the needs of the development. As such, the development would be contrary to policies INF1 and CF5 of the South Oxfordshire Local Plan 2035 and the National Planning Policy Framework.
