Conditions / Refusal Reasons
That the development hereby approved shall be carried out in accordance with the details shown on the following approved plans 22052-PP0010-B and 22052-PP0030-A and supporting information accompanying the application and the following plans approved under application reference P22/S0927/FUL; 16113 L02 B and 16113-PE0010 D and supporting information accompanying the application and the following plans approved under application reference P21/S0747; 16113-PP0012 C and approved under application dereference P18/S3069/FUL 16113 PP0011 C and 8180139/6101 Rev D except as controlled or modified by conditions of this permission. Reason: To secure the proper planning of the area in accordance with Development Plan policies.

That, unless otherwise agreed in writing the development shall be constructed in materials approved under application reference P21/S0746/DIS. Reason: In the interests of the visual appearance of the development in accordance with Policies DES1 and DES2 of the South Oxfordshire Local Plan 2035.

That, unless otherwise agreed in writing the development shall be carried out in accordance with Geo-Environmental Site Investigation reference BRD3517-OR2-A and Remediation Strategy reference BRD3517-OR3-A March 2021 approved under application reference P21/S0746/DIS. Reason: To ensure that any ground, water and associated gas contamination is identified and adequately addressed to ensure the safety of the development, the environment and to ensure the site is suitable for the proposed use in accordance with Policy ENV11 of the South Oxfordshire Local Plan 2035.

The development shall be carried out as per RETROSPECTIVE GROUND GAS MITIGATION MEASURES, 3 rd PARTY INDEPENDENT INSPECTION,TESTING & VALIDATION REPORT: Document Reference No: MTS.RSVR-749-B Dated November 2021 approved under application reference P22/S1830/DIS. Reason: To ensure that any ground, water and associated gas contamination is identified and adequately addressed to ensure the safety of the development, the environment and to ensure the site is suitable for the proposed use in accordance with Policy ENV11 of the South Oxfordshire Local Plan 2035.

The cill level of the roof lights in the north east and south west elevation shall be at least 1.7 metres above the floor level of the associated rooms and shall be retained as such. Reason: To ensure that the development is not unneighbourly in accordance with Policy DES6 of the South Oxfordshire Local Plan 2035.

The proposed privacy screens to the sides of the balconies shown on the approved plans shall be provided prior to the first occupation of the development and shall be retained as such. Reason: To ensure that the development is not unneighbourly in accordance with Policy DES6 of the South Oxfordshire Local Plan 2035.

That unless otherwise agreed in writing by the local planning authority the landscaping of the development shall be carried out in accordance with the details approved under application reference P21/S0746/DIS Reason: To help to assimilate the development into its surroundings in accordance with Policy ENV1 of the South Oxfordshire Local Plan 2035.

Prior to the first occupation of the development, the existing means of access onto Church Road shall be improved and laid out as approved on drawing 8180139/6101D and constructed strictly in accordance with the local highway authority's specifications and all ancillary works specified shall be undertaken Reason: In the interest of highway safety in accordance with Policy TRANS5 of the South Oxfordshire Local Plan 2035.

The vision splays shown on the approved plan 8180139/6101 Rev D shall not be obstructed by any object, structure, planting or other material with a height exceeding or growing above 0.9 metres as measured from carriageway level. Reason: In the interest of highway safety in accordance with Policy TRANS5 of the South Oxfordshire Local Plan 2035.

Prior to the first occupation of the development hereby approved, the parking and turning areas shall be provided in accordance with the approved plan 22052-PP0010B and shall be constructed, laid out, surfaced, drained and completed to be compliant with sustainable drainage (SuDS) principles, and shall be retained unobstructed except for the parking of vehicles associated with the development at all times. Reason: In the interests of highway safety and in accordance with Policies TRANS5 of the South Oxfordshire Local Plan 2035.

That, unless otherwise agreed in writing by the local planning authority, the development shall be carried out in accordance with the level details approved under application reference P21/S0746/DIS. Reason: To ensure a satisfactory form of development in accordance with Policy DES1 and DES2 of the South Oxfordshire Local Plan 2035.

Prior to the occupation of any flat hereby approved, one Electric Vehicle Charging Point shall be provided for that flat and made available for operational use. Thereafter the Electric Vehicle Charging Points shall be retained as approved, other than in the event subsequent upgraded equipment or a replacement EVCP is installed. Reason: To provide measures which contribute to the use of sustainable transport modes and provide facilities for charging plug-in and other ultra-low emission vehicles and address issues of adaptation to climate change, in accordance with Policy DES10 of the South Oxfordshire Local Plan 2035

That, unless otherwise agreed in writing by the local planning authority the Cycle parking facilities shall be provided as per the details approved on drawing 22052-PP0010-B and thereafter retained. Reason: To encourage the use of cycles as a means of transport in accordance with Policy TRANS5 of the South Oxfordshire Local Plan 2035.
