S73 application for Variation of condition 2(approved plans) & 10(Parking & Manoeuvring Areas) on application P19/S4168/FUL because as built parking areas differ from plans and step out balcony has been added to plot 3. (As amended by plan received 08 November 2022).
(Variation of condition 2(approved plans) on application P19/S1585/FUL(Construction of three detached houses on land to rear of 31 West End).
Conditions / Refusal Reasons
That the development hereby approved shall be carried out in accordance with the details shown on the following approved plans, WST.P101N and WST.P3.P140M
and the following plans approved under application reference P19/S4168/FUL;
WST.PT.P120 Rev E
and the following plans approved under application reference P19/S1585/FUL;
WST.P110.REV B
except as controlled or modified by conditions of this permission.
Reason: To secure the proper planning of the area in accordance with Development Plan policies.
That, unless otherwise agreed in writing by the Local Planning Authority the development hereby approved shall be carried out in accordance with the surface water drainage works approved under application P19/S4340/DIS.
Reason: To prevent pollution and flooding in accordance with Policy INF4 of the South Oxfordshire Local Plan 2035 and Policy I1 of the Cholsey Neighbourhood Plan.
That, unless otherwise agreed in writing by the Local Planning Authority the development hereby approved shall be carried out in accordance with the materials approved under application P19/S4340/DIS.
Reason: In the interests of the visual appearance of the development in accordance with Policies DES1 and DES2 of the South Oxfordshire Local Plan 2011 and H5 of the Cholsey Neighbourhood Plan.
That, unless otherwise agreed in writing by the Local Planning Authority the development hereby approved shall be carried out in accordance with the boundary walls and fences details approved under application P19/S4340/DIS.
Reason: In the interests of the visual appearance and neighbouring amenity of the development in accordance with Policy DES1, DES2 and DES6 of the South Oxfordshire Local Plan 2035 and H5 of the Cholsey Neighbourhood Plan.
That, unless otherwise agreed in writing by the Local Planning Authority the development hereby approved shall be carried out in accordance with the tree protection measures approved under application reference P19/S4340/DIS and the approved measures shall be kept in place during the entire course of development.
Reason: To safeguard trees which are visually important in accordance with Policy ENV1 of of the South Oxfordshire Local Plan 2035 and E1 of the Cholsey Neighbourhood Plan .
That, unless otherwise agreed in writing by the Local Planning Authority the development hereby approved shall be carried out in accordance with the construction traffic management plan approved under application P19/S4340/DIS.
Reason: In the interests of highway safety and to mitigate the impact of construction vehicles on the surrounding highway network, road infrastructure and local residents, particularly at morning and afternoon peak traffic times and in accordance with Policy TRANS5 of the South Oxfordshire Local Plan 2035.
That, unless otherwise agreed in writing by the Local Planning Authority the development hereby approved shall be carried out in accordance with the landscaping scheme approved under application P19/S4340/DIS.
Reason: To help to assimilate the development into its surroundings in accordance with Policies ENV1, DES1 and DES 2 of the South Oxfordshire Local Plan 2035 and Policy H5 of the Cholsey Neighbourhood Plan.
Prior to occupation of the development hereby permitted the proposed means of access onto West End is to be formed and laid out and constructed strictly in accordance with the local highway authority's specifications and all ancillary works specified shall be undertaken.
Reason: In the interest of highway safety in accordance with Policy TRANS5 of the South Oxfordshire Local Plan 2035.
Prior to the first occupation of the development hereby approved, the parking and turning areas shall be provided in accordance with the approved plan WST.P101, Rev N and shall be constructed, laid out, surfaced, drained and completed to be compliant with sustainable drainage (SuDS) principles, and shall be retained unobstructed except for the parking of vehicles associated with the development at all times.
Reason: In the interests of highway safety and in accordance with Policies TRANS5 of the South Oxfordshire Local Plan 2035.
The vision splays shown on the approved plan WST.P101, Rev N shall not be obstructed by any object, structure, planting or other material with a height exceeding or growing above 0.9 metres as measured from carriageway level.
Reason: In the interest of highway safety in accordance with Policy TRANS5 of the South Oxfordshire Local Plan 2035.
The garage accommodation hereby approved shall be retained as such and shall not be adapted for living purposes without planning permission from the Local Planning Authority.
Reason: In the interests of highway safety and to ensure the provision of adequate off-street car parking in accordance with Policy TRANS5 of the South Oxfordshire Local Plan 2035 and Policy H6 of the Cholsey Neighbourhood Plan.
Notwithstanding the provisions of the Town and Country Planning (General Permitted Development) Order 2015 (or any Order revoking or re-enacting that Order), the enlargement, improvement or other alteration of any dwellinghouse as described in Schedule 2, Part 1, Class A of the Order shall not be undertaken without obtaining planning permission for the Local Planning Authority.
Reason: To ensure the Local Planning Authority retains control over any future development as specified in the condition in the interests of amenity and in accordance with Policy ENV1, DES1 and DES2 of the South Oxfordshire Local Plan 2035.
