Conditions / Refusal Reasons
The development to which this permission relates must be begun not later than 14 February 2023. Reason: By virtue of Sections 91 to 95 of the Town and Country Planning Act 1990 as amended by section 51 of the Planning and Compulsory Purchase Act 2004.

That the development hereby approved shall be carried out in accordance with the details shown on the following approved plans, WHTLY-LP-001, BN011-0-WHE-001.4. Rev 1, BN011-0-WHE-002 and BN011-0-WHE-001.10 Rev 3, WHTLY-PSP-001 and BN011-0-WHE-001.1 Rev 2 from application ref P22/S0589/FUL (landscaping) except as controlled or modified by conditions of this permission. Reason: To secure the proper planning of the area in accordance with Development Plan policies.

The planning permission hereby granted is for a period from the date of this decision until the date occurring 25 years after the date of commencement of the development hereby permitted. Written notification of the date of commencement shall be given to the local planning authority no later than 14 days after the event. Reason: In view of the temporary nature of the development and in accordance with Policy ENV1 of the adopted South Oxfordshire Local Plan 2035.

No later than 12 months prior to the end of this permission, a site restoration scheme shall be submitted to and approved in writing by the local planning authority. The scheme shall include a programme of works to remove the plant and related equipment, and shall be fully implemented within 12 months of the expiry of this permission. Reason: To safeguard the character of the area in accordance with Policy ENV1 of the South Oxfordshire Local Plan 2035.

The development hereby approved shall be completed and maintained in accordance with the submitted plan (BN011-0-WHE-001.1 Rev 2 from application ref P22/S0589/FUL) and scheme for the Landscape Management Plan (prepared by Clive Fagg Planning, dated January 2022). Reason: To help to assimilate the development into its surroundings in accordance with Policy ENV1 of the South Oxfordshire Local Plan 2035.

Prior to the commencement of development, a full surface water drainage Scheme based on Peak Associates Surface Water Runoff Technical Note reference QA22/015 dated June 2022 (approved under planning application ref P22/S0589/FUL) including details of the size, position and construction of drainage works, shall be submitted to, and approved in writing by, the Local Planning Authority. The drainage scheme shall be implemented in accordance with the approved details prior to the occupation of the development Reason: To prevent pollution and flooding in accordance with Policies EP4 and INF4 of the South Oxfordshire Local Plan 2035.

The construction of the development hereby approved shall be undertaken in accordance with the submitted Construction Traffic Management Plan (prepared by Clive Fagg Planning, dated January 2022 and approved under planning application ref P22/S0589/FUL). Reason: In the interests of highway safety and to mitigate the impact of construction vehicles on the surrounding highway network, road infrastructure and local residents, particularly at morning and afternoon peak traffic times and in accordance with Policy TRANS5 of the South Oxfordshire Local Plan 2035.

Prior to the first use of the development hereby approved, the parking and turning areas shall be provided in accordance with the approved plan BN011-0-WHE-001.10 rev 3 and shall be constructed, laid out, surfaced, drained and completed to be compliant with sustainable drainage (SuDS) principles, and shall be retained unobstructed except for the parking of vehicles associated with the development at all times. Reason: In the interests of highway safety and in accordance with Policy TRANS5 of the South Oxfordshire Local Plan 2035.

No building or raising of land levels shall take place along the line of the access track within the flood zone 3 land. Reason: To prevent increased risk of flooding due to impedance of flood flows and reduction of flood storage capacity in accordance with Policy EP4 of the South Oxfordshire Local Plan 2035.
