Conditions / Refusal Reasons
That the development hereby approved shall be carried out in accordance with the details shown on the following approved plans, MM1386-50.01B, MM1386-50.02A, BLO001, MM1386-30.05C, MM1386-10.05A, MM1386-20.08E, MM1386-30.04C, MM1386-10.01, MM1386 30 03B, MM1386-10.02, MM1386-10.04, MM1386-20.03B, MM1386-10.03, MM1386-20.02C, MM1386 30.09, MM1386 30.08 and MM1386-20.01H, and the Finishes and Materials Schedule dated 08/11/22 except as controlled or modified by conditions of this permission. Reason: To secure the proper planning of the area in accordance with Development Plan policies.

The exterior of the development hereby permitted shall only be constructed in the materials specified on the plans/supporting documents hereby approved or in materials which shall previously have been approved in writing by the Local Planning Authority. Reason: In the interests of the visual appearance of the development and in the interests of safeguarding the character of the listed building in accordance with Policies DES1, DES2, ENV6 and ENV7 of the South Oxfordshire Local Plan 2035.

The applicant, or their agents or successors in title, shall be responsible for organising and implementing an archaeological watching brief, to be maintained during the period of construction/during any groundworks taking place on the site. The watching brief shall be carried out by a professional archaeological organisation in accordance with a Written Scheme of Investigation that has first been approved in writing by the Local Planning Authority. Reason: To secure the protection of and proper provision for any archaeological remains in accordance with Policy ENV9 of the South Oxfordshire Local Plan 2035.

Following the approval of the Written Scheme of Investigation referred to in condition 3, no relevant development shall commence on site without the appointed archaeologist being present. Once the watching brief has been completed its findings shall be reported to the Local Planning Authority, as agreed in the Written Scheme of Investigation, including all processing, research and analysis necessary to produce an accessible and useable archive and a full report for publication which shall be submitted to the Local Planning Authority within two years of the completion of the archaeological fieldwork. Reason: To enable an appropriate level of archaeological investigation of the area including excavation and recording, post excavation analysis and the publication of results in accordance with Policy ENV9 of the of the South Oxfordshire Local Plan 2035.

The electrostatic air cleaner and kitchen extraction unit hereby approved shall be installed, implemented and maintained in accordance with the details set out within the odour assessment, prepared by Air and Acoustic Consultants (June 2022) and as specified by the manufacturer. Reason: To protect the occupants of nearby residential properties from loss of amenity due to odour disturbance and in accordance with Policy ENV12 of the South Oxfordshire Local Plan 2035.

The electrostatic air cleaner, kitchen extraction unit and exchange units serving the cold stores hereby approved shall be installed, implemented and maintained in accordance with the details set out within the noise assessment, prepared by Air and Acoustic Consultants (June 2022) and as specified by the manufacturer. Reason: To protect the occupants of nearby residential properties from loss of amenity due to noise disturbance and in accordance with Policy ENV12 of the South Oxfordshire Local Plan 2035.

The development hereby approved shall be implemented in accordance with all of the measures stated in section 5 of the supporting Nocturnal Bat Survey Report (RPS, 27/09/2022). Reason: To minimise the ecological impacts of development, in accordance with Policy ENV2 of the South Oxfordshire Local Plan 2035 and paragraphs 174 and 180 of the NPPF.

A detailed plan showing provision of car parking spaces to be provided within the site in accordance with the District Council's adopted car parking standards shall be submitted to and approved in writing by the Local Planning Authority within three months of the date of this decision. The parking spaces shall be laid out, surfaced, drained and completed to be compliant with sustainable drainage (SuDS) principles in strict accordance with the approved details. Thereafter the car parking spaces shall be retained unobstructed except for the parking of vehicles associated with the development at all times. Reason: In the interests of highway safety and to ensure the provision of off-street car parking in accordance with Policy TRANS5 of the South Oxfordshire Local Plan 2035.

No lighting shall be installed at the development hereby approved until a lighting scheme has been submitted to and approved in writing by the Local Planning Authority. The scheme shall be designed in accordance with the Institute of Lighting Professional Guidance for the reduction of obtrusive light, Bats and artificial lighting in the UK (Guidance Note 08/18) to avoid obtrusive light spill onto adjacent residential properties and natural habitats. Details shall include: a) Details of all the equipment uses, specific lamps, luminaries and columns with images. b) For each luminaire a full technical specification (e.g. wattage, colour rating) c) Isolux diagrams overlaid over the site and adjacent areas d) Details of lighting operation hours and months of year e) Details of lighting control mechanisms (e.g. PIR sensors, fixed switches, etc.) Any such lighting shall be implemented in accordance with the approved details and directed downwards to prevent light spillage. Reason: To protect the appearance of the area, the environment and wildlife, and local residents from light pollution in accordance with Policies ENV1, ENV2, ENV3 and ENV12 of the South Oxfordshire Local Plan 2035.
