Conditions / Refusal Reasons
That the development hereby approved shall be carried out in accordance with the details shown on the following approved plans, CWLD-BH-CE-LA-2203-01, TPTCER-TR-001 and TPTCER-TR-002, except as controlled or modified by conditions of this permission. Reason: To secure the proper planning of the area in accordance with Development Plan policies.

The materials to be used in the external finish of the development hereby approved shall be in accordance with the details agreed under Discharge of Condition application reference P18/S2739/DIS. Reason: In the interests of the visual appearance of the development in accordance with Policies DES1 and DES2 of the South Oxfordshire Local Plan 2035.

The new landscaping scheme (CWLD-BH-CE-LA-2203-01; CWLD-BH-CE-LA-2203-02; CWLD-BH-CE-LA-2203-03) shall be implemented within the next planting season unless an alternative timescale has been first agreed in writing by the Local Planning Authority. It shall thereafter be maintained in accordance with the approved scheme. In the event of any of the trees or shrubs so planted dying or being seriously damaged or destroyed within 5 years of the completion of the development, a new tree or shrub or equivalent number of trees or shrubs, as the case may be, of a species first approved by the Local Planning Authority, shall be planted and properly maintained in a position or positions first approved in writing by the Local Planning Authority. Reason: To help to assimilate the development into its surroundings in accordance with Policies ENV1, DES1 and DES2 of the South Oxfordshire Local Plan 2035.

The tree protection measures detailed in the approved Arboricultural Method Statement (ACD Environmental, ref: JPP21523aia-ams) shall be retained in situ for the duration of development. Reason: To safeguard trees which are visually important in accordance with Policy ENV1 of the South Oxfordshire Local Plan 2035.

The development shall be implemented strictly in accordance with the land contamination remedial strategy (Terramech Phase 1 & 2 Environmental & Geotechnical Investigation No 4044/18 Revision 1; 15 October 2018) approved under application reference P18/S2739/DIS. Reason: To ensure that any ground, water and associated gas contamination is identified and adequately addressed to ensure the safety of the development, the environment and to ensure the site is suitable for the proposed use in accordance with Policy ENV12 of the South Oxfordshire Local Plan 2035.

The development hereby permitted shall be implemented in accordance with the recommendations of the Bat Mitigation report (The Ecology Partnership) approved under application reference P18/S2739/DIS. Any variation shall be agreed in writing by the Local Planning Authority before such change is made. Reason: To protect the important species on the site, in accordance with provisions of the NPPF and Policies ENV2 and ENV3 of the South Oxfordshire Local Plan 2035.

Within six months of the date of this permission, or in accordance with an alternative timescale first agreed in writing by the Local Planning Authority, the proposed means of access onto Horsepond Road, is to be formed and laid out and constructed strictly in accordance with the local highway authority's specifications and all ancillary works specified shall be undertaken. Reason: In the interest of highway safety in accordance with Policy TRANS5 of the South Oxfordshire Local Plan 2035

Before the proposed access is first used, the existing access onto the A4074 shall be permanently stopped up by the means of reinstatement of the highway verge and proposed planting in accordance with the approved landscaping plan and the local highway authority's specifications. Thereafter the closed access shall not be used by any vehicular traffic whatsoever. Reason: In the interest of highway safety in accordance with Policy TRANS5 of the South Oxfordshire Local Plan 2035

The vision splays shown on the approved site access plan (18_86_627, A1) shall not be obstructed by any object, structure, planting or other material with a height exceeding or growing above 0.9 metres as measured from carriageway level. Reason: In the interest of highway safety in accordance with Policy TRANS5 of the South Oxfordshire Local Plan 2035

Prior to the occupation of each dwelling of the development hereby approved, its parking and turning areas shall be provided in accordance with the approved site plan (18_86_627, A1) and shall be constructed, laid out, surfaced, drained and completed to be compliant with sustainable drainage (SuDS) principles, and shall be retained unobstructed except for the parking of vehicles associated with the development at all times. Reason: In the interests of highway safety and in accordance with Policy TRANS5 of the South Oxfordshire Local Plan 2035

The Construction Traffic Management Plan (Uxbridge Design,10th August 2018) approved under application reference P18/S2739/DIS shall be implemented prior to any works being carried out on site, and shall be maintained throughout the course of the development. Reason: In the interests of highway safety and to mitigate the impact of construction vehicles on the surrounding highway network, road infrastructure and local residents, particularly at morning and afternoon peak traffic times and in accordance with Policy TRANS5 of the South Oxfordshire Local Plan 2035

The off-site highway works shown on approved plan (18_86_627, A1) or as otherwise agreed in writing with the Local Planning Authority shall be implemented in full within 6 months of the date of this permission, or in accordance with a programme of implementation first agreed in writing with the Local Planning Authority Reason: In the interest of highway safety in accordance with Policy TRANS5 of the South Oxfordshire Local Plan 2035.
