Conditions / Refusal Reasons
The application site is not allocated for development in either the South Oxfordshire Local Plan 2035, or the Chalgrove Neighbourhood Plan (CNP) (2018) and lies outside the built-up area of the settlement. The development does not accord with the spatial strategy for housing within the district, as set out in policies STRAT1 and H1 of the South Oxfordshire Local Plan 2035, and would also be contrary to policy C1 of the Chalgrove Neighbourhood Plan.
The proposal would breach an existing strong and established landscape boundary on the south-eastern edge of Chalgrove introducing urban development into the open countryside. The proposed development would cause harm to the rural landscape and open countryside contrary to policy ENV1 of the South Oxfordshire Local Plan 2035 and policy C1 of the Chalgrove Neighbourhood Plan.
The submitted application has failed to provide sufficient information to fully assess the impacts of the proposals on the below ground archaeology which is present in this location. As such the application is unable to demonstrate the impact upon the significance of the asset, as required by Paragraph 194 of the NPPF and the application is therefore contrary to policy ENV9 of the South Oxfordshire Local Plan 2035.
In the absence of a completed Section 106 legal agreement, the proposal fails to secure affordable housing to meet the of the development. As such, the development would be contrary to policies H9 and H11 of the South Oxfordshire Local Plan 2035 and the National Planning Policy Framework.
