Variation of conditions 2 (approved plans) & 4 (turning area & car parking) - revised location/siting for workshop and parking area on application P18/S3070/HH. (as amplified by Tree Protection Plan received 28 April 2022 and site section received 20 May 2022)
Demolition of existing collection of dilapidated sheds, and erection of x1 barn building to accommodate workshop, study and store for animal feed and garden equipment.
Conditions / Refusal Reasons
The development to which this permission relates must be begun not later than 17 June 2022.
Reason: By virtue of Sections 91 to 95 of the Town and Country Planning Act 1990 as amended by section 51 of the Planning and Compulsory Purchase Act 2004.
That the development hereby approved shall be carried out in accordance with the details shown on the following approved plans, 19107-PP100, 19107-L01 A, Arbtech TPP 01 Rev A, 1907-PP101 and 16/1952 014 Rev A, except as controlled or modified by conditions of this permission.
Reason: To secure the proper planning of the area in accordance with Development Plan policies.
The tree protection details as shown on the approved drawing ref: Arbtech TPP 01 Rev A shall be put in place prior to any on site works (including demolition) and thereafter retained in situ for the duration of the construction of the development.
Reason: To safeguard trees which are visually important in accordance with Policy ENV1 of the South Oxfordshire Local Plan 2011
The exterior of the development hereby permitted shall only be constructed in the materials as approved under P22/S1374/DIS or in materials which shall previously have been approved in writing by the Local Planning Authority.
Reason: To ensure the setting of the grade II listed cottage and visual amenities of the Green Belt are preserved in accordance with Policies DES1, DES2 and ENV7 of the South Oxfordshire Local Plan 2035.
Prior to the first occupation of the development hereby approved, the parking and turning areas shall be provided in accordance with drawing no. 19107 - PP100, and shall be constructed, laid out, surfaced, drained and completed to be compliant with sustainable drainage (SuDS) principles, and shall be retained unobstructed except for the parking of vehicles associated with the development at all times.
Reason: In the interests of highway safety and to ensure the provision of off-street car parking in accordance with Policy TRANS5 of the South Oxfordshire Local Plan 2035.
The building hereby permitted shall not be occupied at any time other than for purposes ancillary to the residential use of the dwelling known as The Orchard in accordance with the uses as stated on the approved floor plans of drawing number 014 Rev.A - Planning, Proposed Plans and Elevations.
Reason: As the separate occupation of the accommodation would represent an undesirable sub-division of the property and result in inadequate standards of amenity and privacy in accordance with Policy H20 of the South Oxfordshire Local Plan 2035.
