The erection of the dwellinghouse on the land shown in red on plan number CLD-01 amounted to a material change of use of the land which was in equestrian use. Therefore, the continued use of the building as a single dwellinghouse and the use of the outbuildings and land within the red line area as ancillary to this use would not be lawful in respect of S.191 of the Act as enforcement action can still be taken against the breach of planning control as less than ten years have passed as per S.171B(3) of the Act.
