Variation of Conditions application on application P21/S0030/FUL (Demolition of existing dwelling house and erection of a new two and a half storey replacement dwelling) for a change in brick, roof and dormer cladding specification.
Conditions / Refusal Reasons
The development to which this permission relates must be begun not later than 12 March 2024.
Reason: By virtue of Sections 91 to 95 of the Town and Country Planning Act 1990 as amended by section 51 of the Planning and Compulsory Purchase Act 2004.
That the development hereby approved shall be carried out in accordance with the details shown on the following approved plans, PL.1510.B, PL.1511.B, PL.1210 and PL.1512.B, except as controlled or modified by conditions of this permission.
Reason: To secure the proper planning of the area in accordance with Development Plan policies.
The tree protection details as shown on the approved Arboricultural Method Statement dated 26th July 2021 in conjunction with the comments added to the revised drainage drawing 0200 P05 approved under discharge of condition application P22/S0319/DIS shall be put in place prior to any on site works including demolition and thereafter retained in situ for the duration of development.
Reason: To safeguard trees which are visually important in accordance with Policies ENV1, DES1, and DES2 of the South Oxfordshire Local Plan 2035.
The surface water drainage scheme shall be implemented in accordance with the details agreed under discharge of condition application P22/S0319/DIS prior to the occupation of the development hereby approved.
Reason: To ensure the proper provision of surface water drainage and to ensure flooding is not exacerbated in the locality in accordance with Policy EP4 of the South Oxfordshire Local Plan 2035.
The foul water drainage scheme shall be implemented in accordance with the details agreed under discharge of condition application P22/S0319/DIS prior to the occupation of the development hereby approved.
Reason: To ensure the proper provision of foul water drainage and to ensure flooding and pollution is not exacerbated in the locality in accordance with policy EP4 of the South Oxfordshire Local Plan 2035.
The exterior of the development hereby permitted shall only be constructed in the materials specified on the plans/supporting documents hereby approved or in materials which shall previously have been approved in writing by the Local Planning Authority.
Reason: In the interests of the visual appearance of the development in accordance with Policies DES1 and DES2 of the South Oxfordshire Local Plan 2035.
The measures set out in Energy Statement prepared by Energytest, which accompanied the application, in respect of sustainable building, shall be implemented prior to the first occupation of the development, unless as may otherwise be agreed in writing by the Local Planning Authority.
Reason: To ensure high standards of sustainable design and construction in accordance with Policy DES10 of the South Oxfordshire Local Plan 2035.
The development hereby approved shall be implemented in strict accordance with the measures stated in section 5 Bat Mitigation Strategy of the Bat Survey Report (Windrush Ecology, August 2018, REF: W2882_rep_Maybury House,
Shiplake_28-08-18). For avoidance of doubt this must include installation of one bat box.
Reason: To minimise the impacts of development on biodiversity and achieve net gains for biodiversity, in accordance with ENV2 and ENV3 of the SOLP 2035 and paragraph 170 and 175 of the NPPF.
Notwithstanding the provisions of the Town and Country Planning (General Permitted Development) Order 2015 (or any Order revoking or re-enacting that Order), the enlargement, improvement or other alteration of any dwellinghouse as described in Schedule 2, Part 1, Class A of the Order shall not be undertaken without obtaining planning permission from the Local Planning Authority.
Reason: To safeguard the amenities of the occupiers of the adjoining properties and the character of the area in accordance with Policies DES1, DES2 and DES6 of the South Oxfordshire Local Plan 2035.
