Conditions / Refusal Reasons
The application site is not allocated for development in either the South Oxfordshire Local Plan 2035 or the Woodcote Neighbourhood Plan Review, and lies outside the built-up area of the settlement. The development does not accord with the distribution strategy for housing within the district, as set out in policies STRAT1 and H1 and H4 of the South Oxfordshire Local Plan 2035, and would also be contrary to policy E4 of the Woodcote Neighbourhood Plan review. The principle of the development is therefore unacceptable. Furthermore, the proposal would constitute a major development within the Chilterns Area of Outstanding Natural Beauty (AONB) and there are no exceptional circumstances that are in the public interest that would justify this major development within the AONB. As such, the development would be contrary to the National Planning Policy Framework and policy ENV1 of the South Oxfordshire Local Plan.
The proposed development would intrude beyond the well defined settlement edge into open AONB countryside, which is currently largely unaffected by the adjacent settlement, and introduce an urban form of development that would result in the loss of AONB countryside, and as such the development would cause landscape harm and would fail to conserve and enhance the character and natural beauty of the AONB, contrary to the National Planning Policy Framework, policy ENV1 of the South Oxfordshire Local Plan 2035 and policy E6 of the Woodcote Neighbourhood Plan Review.
In the absence of a completed S106 legal agreement, the proposal fails to secure affordable housing to meet the needs of the District. As such, the development would be contrary to the National Planning Policy Framework, policies H9 and H11 of the South Oxfordshire Local Plan and policies H2 and H3 of the Woodcote Neighbourhood Plan Review.
In the absence of a completed S106 legal agreement, the proposal fails to secure infrastructure necessary to meet the needs of the development. As such, the development would be contrary to the National Planning Policy Framework and policies INF1 and CF5 of the South Oxfordshire Local Plan.
