The retrospective elements of the planning permission hereby permitted shall be completed within one year of the date of this planning permission. Reason: To ensure that the development is implemented as intended and to not materially diminish the overall quality of the scheme, in accordance with paragraph. 135 of the National Planning Policy Framework.

Prior to the occupation of each unit to which they relate, the cycle parking facilities shall be provided in accordance with the details agreed under discharge of condition application reference P21/S3576/DIS on 10 May 2022. Reason: To encourage the use of cycling as a means of transport and to mitigate any impacts on air pollution in accordance with Policies TRANS5 and EP1 of the South Oxfordshire Local Plan 2035.

Prior to the occupation of each unit to which they relate, the electric vehicle charging points shall be provided in accordance with the details agreed under discharge of condition application reference P21/S3576/DIS on 10 May 2022. Reason: To encourage the use of electric cars as a means of transport and to mitigate any impacts on air pollution in accordance with Policies TRANS5 and EP1 of the South Oxfordshire Local Plan 2035.

Any gas fired boilers to be installed in any of the dwellings hereby permitted shall meet a minimum standard of <40mgNOx/kWh. Reason: To mitigate any impacts on air pollution in accordance with Policy EP1 of the South Oxfordshire Local Plan 2035.

Prior to occupation of the development hereby permitted the proposed means of access onto Shirburn Road shall be formed and laid out and constructed strictly in accordance with the details agreed under discharge of condition application reference P20/S3475/DIS on 2 November 2020. Reason: In the interest of highway safety in accordance with Policy TRANS5 of the South Oxfordshire Local Plan 2035.

The Construction Traffic Management Plan (CTMP) agreed under discharge of condition application reference P20/S3475/DIS on 2 November 2020 shall be maintained throughout the course of the development. Reason: In the interests of highway safety and to mitigate the impact of construction vehicles on the surrounding highway network, road infrastructure and local residents, particularly at morning and afternoon peak traffic times and in accordance with Policy TRANS5 of the South Oxfordshire Local Plan 2035.

The Travel Plan agreed under discharge of condition application reference P21/S3576/DIS on 10 May 2022 shall be implemented upon occupation of the development hereby permitted and shall be monitored and reviewed in accordance with details to be set out in the approved plan. The Travel Information Pack approved under discharge of condition application reference P21/S3576/DIS shall be provided to the first residents of each dwelling upon occupation. Reason: To promote the use of non car modes of transport in accordance with Policy TRANS4 of the South Oxfordshire Local Plan 2035.

The external lighting shall be carried out in accordance with the details agreed under discharge of condition application reference P20/S4458/DIS on 17 February 2021 Reason: To protect the appearance of the area, the environment and wildlife, and local residents from light pollution in accordance with Policy ENV12 of the South Oxfordshire Local Plan 2035.

The development hereby permitted shall be carried out in accordance with the Arboricultural Method Statement approved under discharge of condition application reference P20/S3475/DIS on 2 November 2020. The tree protection fencing must remain in place for the duration of the construction works. Reason: To safeguard trees which are visually important in accordance with Policies ENV1, DES1, and DES2 of the South Oxfordshire Local Plan 2035.

The long term management of the soft landscaping works shall be in accordance with the details agreed under discharge of condition application reference P20/S4005/DIS on 3 December 2020. Reason: To help to assimilate the development into its surroundings in accordance with Policies ENV1, DES1 and DES2 of the South Oxfordshire Local Plan 2035.

The foul water drainage scheme shall be implemented in accordance with the details agreed under discharge of condition application reference P20/S4458/DIS on 17 February 2021 prior to the occupation of the development hereby approved Reason: To ensure the proper provision of foul water drainage and to ensure flooding and pollution is not exacerbated in the locality in accordance with policy EP4 of the South Oxfordshire Local Plan 2035.

The surface water drainage scheme shall be implemented in accordance with the details agreed under discharge of condition application reference P20/S4458/DIS on 17 February 2021 prior to the occupation of the development hereby approved. Reason: To ensure the proper provision of surface water drainage and to ensure flooding is not exacerbated in the locality in accordance with Policy EP4 of the South Oxfordshire Local Plan 2035.

The development hereby permitted shall be carried out in accordance with the Remediation Strategy and Verification Plan agreed under discharge of condition application reference P21/S0158/DIS on 10 February 2021. Reason: To ensure that any ground, water and associated gas contamination is identified and adequately addressed to ensure the safety of the development, the environment and to ensure the site is suitable for the proposed use in accordance with Policy ENV11 of the South Oxfordshire Local Plan 2035.

The development hereby permitted shall not be occupied until the previously approved remediation strategy has been carried out in full and a validation report confirming completion of these works has been submitted to and approved in writing by the Local Planning Authority. Reason: To ensure that any ground, water and associated gas contamination is identified and adequately addressed to ensure the safety of the development, the environment and to ensure the site is suitable for the proposed use in accordance with Policy ENV11 of the South Oxfordshire Local Plan 2035.

If, during development, contamination not previously identified is found to be present at the site then no further development (unless otherwise agreed in writing with the Local Planning Authority) shall be carried out until the developer has submitted a remediation strategy to the Local Planning Authority detailing how this unsuspected contamination shall be dealt with and obtained written approval from the Local Planning Authority. The remediation strategy shall be implemented as approved. Reason: To ensure that any ground, water and associated gas contamination is identified and adequately addressed to ensure the safety of the development, the environment and to ensure the site is suitable for the proposed use in accordance with Policy ENV11 of the South Oxfordshire Local Plan 2035.

The hours of operation for construction and demolition works shall be restricted to 08:00-18:00 Monday to Friday and 08:00-13:00 on a Saturday. No work is permitted to take place on Sundays or Public Holidays without the prior written authority of the Local Planning Authority. Reason: To ensure that the development is not unneighbourly in accordance with Policy DES6 of the South Oxfordshire Local Plan 2035.

The development hereby permitted shall be carried out in accordance with the noise mitigation measures agreed under discharge of condition application reference P20/S4005/DIS on 3 December 2020. Reason: To ensure that the development is not unneighbourly in accordance with Policies ENV12 of the South Oxfordshire Local Plan 2035.

The retirement unit premises shall be occupied by: - persons aged 55 and over; - persons living as part of a single household with such a person or persons; - persons who were living as part of a single household with such a person or persons who have since died. No unit shall be permanently occupied by any person or persons aged 16 and under. Reason: As general occupation of the development would require a contribution towards the Community Infrastructure Levy to provide appropriate off-site infrastructure and services, in accordance with policy INF1 of the South Oxfordshire Local Plan 2035.

The external construction and finishes of the development hereby permitted shall be in accordance with the materials agreed under discharge of condition application reference P20/S4006/DIS on 1 December 2020. Reason: In the interests of the visual appearance of the development in accordance with Policies DES1 and DES2 of the South Oxfordshire Local Plan 2035.

The landscaping scheme as shown on the approved plans 17-59-PL-240 Rev B, 17-59-PL-241 Rev A, 17-59-PL-242 Rev A, 17-59-PL-243 Rev A, 17-59-PL-244 Rev A and 17-59-PL-245 Rev A shall be implemented prior to the first occupation or use of the approved development and thereafter be maintained in accordance with the approved scheme. In the event of any of the trees or shrubs so planted dying or being seriously damaged or destroyed within 5 years of the completion of the development, a new tree or shrub or equivalent number of trees or shrubs, as the case may be, of a species first approved by the Local Planning Authority, shall be planted and properly maintained in a position or positions first approved in writing by the Local Planning Authority. Reason: To help to assimilate the development into its surroundings in accordance with Policies ENV1, DES1 and DES2 of the South Oxfordshire Local Plan 2035.

The development hereby permitted shall be carried out in accordance with the biodiversity measures agreed under discharge of condition application reference P20/S4006/DIS on 1 December 2020. Reason: To ensure that there is no net loss of biodiversity, in accordance with Policies ENV2 and ENV3 of the South Oxfordshire Local Plan 2035.

The development hereby permitted shall be carried out in accordance with the estate road and footpath details agreed under discharge of condition application reference P20/S4457/DIS on 10 March 2021. Thereafter, before first occupation of any dwelling, the whole of the estate roads and footpaths (except for the final surfacing thereof) shall be laid out, constructed, lit and drained and if required temporary or permanent traffic calming shall be put in place in accordance with the previously approved details. Reason: In the interests of highway safety and to ensure a satisfactory standard of construction and layout for the development in accordance with Policy TRANS5 of the South Oxfordshire Local Plan 2035.

Prior to occupation of any dwelling, the proposed car parking provision shall be provided in accordance with the approved plans. Thereafter, the parking spaces shall be kept permanently free of any obstruction and maintained and retained at all times. Reason: To provide adequate car parking facilities within the site in accordance with the councils adopted parking standards and in the interest of highway safety and in accordance with Policy TRANS5 of the South Oxfordshire Local Plan 2035.
