Conditions / Refusal Reasons
The development to which this permission relates must be begun not later than the expiration of three years beginning with the date of this permission. Reason: By virtue of Sections 91 to 95 of the Town and Country Planning Act 1990 as amended by section 51 of the Planning and Compulsory Purchase Act 2004.

That the development hereby approved shall be carried out in accordance with the details shown on the following approved plans, 6885 01, 6885 02, 6885 06, 6885 03, 6885 04, LTC111 TPP, 6885 03 S1 and MR21-116-101 Rev A, except as controlled or modified by conditions of this permission. Reason: To secure the proper planning of the area in accordance with Development Plan policies.

The development hereby permitted shall only be constructed in the materials specified on the plans and supporting documents hereby approved or in materials which shall previously have been approved in writing by the Local Planning Authority. Reason: In the interests of the visual appearance of the development in accordance with Policies STRAT1, ENV1, DES1 and DES2 of the South Oxfordshire Local Plan 2035.

The development hereby permitted shall only be complete in accordance with the details of the bio diversity mitigation and enhancement strategy set out in 80-972-R1-1- Ecological Construction Management Plan (ECMP) hereby approved or in details which shall previously have been approved in writing by the Local Planning Authority. Reason: To secure bio diversity net gain and minimise the ecological impacts of development, in accordance with Policies STRAT1 and ENV2 of the South Oxfordshire Local Plan 2035 and paragraphs 174 and 180 of the NPPF.

All wildlife tunnels as shown on approved plans MR21-116-101 Rev A and 6885_03_S1 and in accordance with the details set out in the supporting ECO2965b - Biodiversity Metric 3.0 tool - Version 4 and ECO2965c - ECOLOGICAL ASSESSMENT shall be fully implemented and operational prior to the first use of the development and retained as such thereafter. All wildlife tunnels shall be maintained so that no debris, vegetation or water shall obstruct the ready use of the wildlife tunnels. Reason: To ensure that the proposed development does not prevent wildlife from accessing the onsite pond, in accordance with Policies STRAT1 and ENV2 of the South Oxfordshire Local Plan 2035 and paragraphs 174 and 180 of the NPPF.

Prior to fist use of the development hereby approved the landscaping of the site including the provision the grassland management scheme as shown on the approved plan MR21-116-101 Rev A and as detailed within the supporting ECO2965c - ECOLOGICAL ASSESSMENT shall be implemented prior to the first use of the approved development and thereafter be maintained in strict accordance with the approved scheme unless otherwise agreed in writing by the Local Planning Authority. Reason: To provide onsite biodiversity benefits, in accordance with Policies STRAT1 and ENV3 of the South Oxfordshire Local Plan 2035 and paragraphs 174 and 180 of the NPPF

The tree protection details as shown on the approved LTC111 TPP shall be put in place prior to any on site works including demolition and thereafter retained in situ for the duration of development. Reason: To safeguard trees which are visually important in accordance with Policies STRAT1, ENV1, DES1, and DES2 of the South Oxfordshire Local Plan 2035.

No spoil or materials shall be deposited or stored within the Root Protection Area (RPA) of all trees shown to be retained across the site. The 1969sqm of excavated spoil shall be redeposited across the land ling wholly within fluvial flood zone 1 as shown on approved plan 6885_04. Reason: To protect the trees shown to be retained which collectively have significant amenity value, contributing to the green and rural character of the area and prevent increased risk of flooding due to impedance of flood flows and reduction of flood storage capacity in accordance with Policies STRAT1, ENV1, ENV4 and EP4 of the South Oxfordshire Local Plan 2035.
