Conditions / Refusal Reasons
The development to which this permission relates must be begun not later than the expiration of three years beginning with the date of this permission.
Reason: By virtue of Sections 91 to 95 of the Town and Country Planning Act 1990 as amended by section 51 of the Planning and Compulsory Purchase Act 2004.
That the development hereby approved shall be carried out in accordance with the details shown on the following approved plans, TPP 05718 2022 R1, 571-P-2, 571-P-3, 571-P-4 and 571-P-1, except as controlled or modified by conditions of this permission.
Reason: To secure the proper planning of the area in accordance with Development Plan policies.
The tree protection details as shown on the approved Arboricultural Method Statement produced by Duckworths Arboriculture (dated March 2022, Ref: SCD 05762/2022) shall be put in place prior to any on site works including demolition and thereafter retained in situ for the duration of development.
Reason: To safeguard trees which are visually important in accordance with Policies ENV1, DES1, and DES2 of the South Oxfordshire Local Plan 2035.
The exterior of the development hereby permitted shall only be constructed in the materials specified on the plans/supporting documents hereby approved or in materials which shall previously have been approved in writing by the Local Planning Authority.
Reason: In the interests of the visual appearance of the development in accordance with Policies DES1 and DES2 of the South Oxfordshire Local Plan 2035.
The development hereby permitted shall not be occupied at any time other than for purposes ancillary to the residential use of the dwelling known as Robinsgrove Cottage.
Reason: As the separate occupation of the accommodation would represent an undesirable sub-division of the property and result in inadequate standards of amenity and privacy in accordance with Policies DES1, DES2 and DES6 of the South Oxfordshire Local Plan 2035.
Any external lighting will only be permitted in accordance with a detailed lighting scheme to be submitted to and approved in writing by the Local Planning Authority prior to the first occupation of the development hereby approved. Details shall include, as a minimum:
a) luminaire specification (make and model)
b) lumen output and colour temperature (no greater than 2700k)
c) PIR control mechanism (not on a permanent switch)
d) Light angle mitigation (downward facing, directional shields, etc.)
Any such external lighting shall be implemented and retained thereafter in accordance with the approved details.
Reason: To safeguard the appearance of the area, the amenity of local residents and the ecological function of the nearby ancient woodland from obtrusive light spillage, in accordance with Policies ENV1, ENV2 and ENV12 of the South Oxfordshire Local Plan 2035, and paragraphs 174 and 180 of the NPPF.
