The available evidence on the balance of probabilities, supports a conclusion that the building shown within the red line area on plan number LOC001 at The Paddocks in Wheatley was erected as an incidental outbuilding in 2013 which subsequently changed of use to a single dwellinghouse in 2015 and has been occupied as such for a continuous period in excess of four years. As such, the use of the building as a dwellinghouse is now considered to be immune from any planning enforcement as more than four years have passed and it is lawful due to passage of time under Sections 191(2)(a),191(2)(b), and 171B(2) of the Town and Country Planning Act 1990.
