The proposed variation to condition 3 of permission P21/S2631/FUL to allow the use of the pond for swimming will harm visual amenity through erosion of the rural character and tranquillity of the site, result in a net loss in biodiversity from the approved scheme, and result in development that is inappropriate in the Green Belt and contrary to the purposes of including land within it through encroachment into the countryside. There are no material considerations which outweigh this harm and the proposed condition.is not considered to meet the six tests for conditions from the NPPF. Therefore, it is concluded that the application is contrary to the development plan, with particular reference to policies DES1, DES2, ENV1, ENV3 & STRAT6 of the adopted South Oxfordshire Local Plan 2035, and advice contained in the NPPF.
