Description
Variation of condition 2 (Approved drawings), 3 (External materials), 6 (Hard & Soft Landscaping) & 12 (Arboricultural Method Statement) in application P17/S1085/FUL.
(amended plans received 14th October 2021. The changes include:
- Removal of detached garage building. Reconfiguration of dwelling and addition of integral garage. Reduction in width of access (Plot 1);
- Reduction in volume of first floor accommodation within proposed detached garages. Alterations to design, including removal of dormer window features (Plots 2 and 3); and
- Revised landscaping and tree protection details).
(Erection of three detached dwelling houses following demolition of existing dwelling house).
Conditions / Refusal Reasons
That the development hereby approved shall be carried out in accordance with the details shown on the following approved plans, BAL 01 A, BAL 02 A, P21 01 S 201 B, P21 01 S 202 B, P21 01 S 203 B, P21 01 S 210 A, P21 01 S 221 A, P21 01 S 231 A, TPP D, P21 01 S 211, P21 01 S 220, P21 01 S 230 and P21 01 200, except as controlled or modified by conditions of this permission.
Reason: To secure the proper planning of the area in accordance with Development Plan policies.
The materials to be used in the external construction and finishes of the development hereby permitted shall be in accordance with the External Materials Schedule accompanying the application submission.
Reason: In the interests of the visual appearance of the development in accordance with DES1, DES2 and ENV1 of the South Oxfordshire Local Plan 2035
Notwithstanding the provisions of the Town and Country Planning (General Permitted Development) Order 2015 (or any Order revoking or re-enacting that Order), the enlargement, improvement or other alteration of any dwellinghouse as described in Schedule 2, Part 1, Class A of the Order shall not be undertaken without obtaining planning permission for the Local Planning Authority.
Reason: To ensure the Local Planning Authority retains control over any future development as specified in the condition in the interests of amenity and in accordance with Policies DES1, DES2 and DES6 of the South Oxfordshire Local Plan 2035.
The development hereby permitted shall be implemented in accordance with the recommendations made in section 6 of the supporting Protected Species Survey (Philip Irving, received 30/06/2017)
Reason: To protect the important species on the site, in accordance with provisions of the NPPF and policies ENV2 and ENV3 of the South Oxfordshire Local Plan 2035.
The landscaping scheme as shown on the approved plans BAL-01 Rev A and BAL-02 Rev A shall be implemented prior to the first occupation or use of the approved development and thereafter be maintained in accordance with the approved scheme. In the event of any of the soft landscaping so planted dying or being seriously damaged or destroyed within 5 years of the completion of the development, replacement planting, as the case may be, of a species first approved by the Local Planning Authority, shall be planted and properly maintained in a position or positions first approved in writing by the Local Planning Authority.
Reason: To help to assimilate the development into its surroundings in accordance with Policies ENV1, DES1 and DES2 of the South Oxfordshire Local Plan 2035.
Prior to occupation of the development hereby permitted the proposed means of access onto Rotherfield Road is to be formed and laid out and constructed strictly in accordance with the local highway authority's specifications and all ancillary works specified shall be undertaken.
Reason: In the interest of highway safety in accordance with Policy TRANS5 of the South Oxfordshire Local Plan 2035.
Prior to the first occupation of the development, the existing means of access onto Rotherfield Road shall be improved and laid out and constructed strictly in accordance with the local highway authority's specifications and all ancillary works specified shall be undertaken.
Reason: In the interest of highway safety in accordance with Policy TRANS5 of the South Oxfordshire Local Plan 2035.
The vision splays shown on drawing no.B42RR/17/02 shall not be obstructed by any object, structure, planting or other material with a height exceeding or growing above 0.9 metres as measured from carriageway level.

Prior to the first occupation of the development hereby approved, the parking and turning areas shall be provided in accordance with drawing no.P21/01/S/201 Rev B and shall be constructed, laid out, surfaced, drained and completed to be compliant with sustainable drainage (SuDS) principles, and shall be retained unobstructed except for the parking of vehicles associated with the development at all times.
Reason: In the interests of highway safety and in accordance with Policy TRANS5 of the South Oxfordshire Local Plan 2035
All upper-storey side facing windows within the side elevations of the dwellings hereby approved shall be glazed in obscure glass with a minimum of level 3 obscurity and fixed shut, where below 1.7m from the finished floor level in each associated room. The windows shall shall be retained as such thereafter.
Reason: To ensure that the development is not unneighbourly in accordance with Policy DES6 of the South Oxfordshire Local Plan 2035.
The development shall be implemented in accordance with the Construction Traffic Management Plan (CTMP) approved under discharge of condition application ref: P20/S2699/DIS, The approved CTMP shall be implemented prior to any works being carried out on site, and shall be maintained throughout the course of the development.
Reason: In the interests of highway safety and to mitigate the impact of construction vehicles on the surrounding highway network, road infrastructure and local residents, particularly at morning and afternoon peak traffic times and in accordance with Policy T1 of the South Oxfordshire Local Plan 2011.
The tree protection details as shown on the approved Arboricultural Method statement (October 21) and Tree Protection Plan (TPP Rev D) shall be put in place prior to the recommencement of any site works and thereafter retained in situ for the duration of development.
Reason: To safeguard trees which are visually important in accordance with Policies ENV1, DES1, and DES2 of the South Oxfordshire Local Plan 2035.
