Conditions / Refusal Reasons
The development to which this permission relates must be begun not later than 30 March 2023. Reason: By virtue of Sections 91 to 95 of the Town and Country Planning Act 1990 as amended by section 51 of the Planning and Compulsory Purchase Act 2004.

That the development hereby approved shall be carried out in accordance with the details shown on the following approved plans, PL 01, 1245 PL 021 Rev B, 1245 PL 022 Rev B, 2018 10 01, C101 Rev D, 0089 GA 0002 Rev P03, P101 Rev C, P102 Rev C, 1245 PL 018 Rev B, 1245 PL 019 Rev B, 1245 PL 020 Rev B, 1245 PL 023 Rev B, PL026 Rev A, 1245 PL 017 Rev B, L101 Rev D, 1245 PL 016 Rev B, C102 Rev D, P103 Rev C and 2021-07-05 HTS-TPP-01F, except as controlled or modified by conditions of this permission. Reason: To secure the proper planning of the area in accordance with Development Plan policies.

The development hereby approved shall be carried out in accordance with the ground and finished floor and ridge levels shown on the plans hereby approved unless otherwise first agreed in writing by the Local Planning Authority. Reason: In the interests of the visual appearance of the development in accordance with Policies DES1, DES2 and ENV1 of the South Oxfordshire Local Plan 2035.

The exterior of the development hereby permitted, including the areas of hard surfacing, shall only be constructed in accordance with the materials specified on the Schedule of proposed finishes and materials (Appendix 15 Revision P02) hereby approved or in materials which shall previously have been approved in writing by the Local Planning Authority. Reason: In the interests of the visual appearance of the development in accordance with Policies DES1, DES2 and ENV1 of the South Oxfordshire Local Plan 2035.

The tree protection details as shown on the approved tree protection plan, HTS-TPP-01F, and contained within the Arboricultural Method Statement dated December 2019 submitted for application P20/S0183/FUL (except for the superseded tree protection plan within this document) shall be put in place prior to any on site works including demolition and thereafter retained in situ for the duration of development. Reason: To safeguard trees which are visually important in accordance with Policy ENV1 of the South Oxfordshire Local Plan 2035.

The landscaping scheme as shown on the approved plans, P102C and P103C, shall be implemented prior to the first occupation of the new dwelling hereby approved and thereafter be maintained in accordance with the approved scheme. In the event of any of the trees or shrubs so planted dying or being seriously damaged or destroyed within 5 years of the completion of the development, a new tree or shrub or equivalent number of trees or shrubs, as the case may be, of a species first approved by the Local Planning Authority, shall be planted and properly maintained in a position or positions first approved in writing by the Local Planning Authority. Reason: To help to assimilate the development into its surroundings in accordance with Policies DES1, DES2 and ENV1 of the South Oxfordshire Local Plan 2035.

The boundary walls, fences, gates and other means of enclosure as shown on the approved plans, PL-02, and PL-024 (submitted under application P20/S0183/FUL) and 0089-GA-0002 P03 shall be implemented prior to the first occupation of the new dwelling hereby approved and thereafter shall be maintained in accordance with the approved details. Reason: In the interests of the visual appearance of the development in accordance with Policies DES1, DES2 and ENV1 of the South Oxfordshire Local Plan 2035.

Unless otherwise agreed in writing by the Local Planning Authority the surface water drainage scheme shall be implemented in accordance with the details approved under application P21/S1335/DIS prior to the occupation of the development hereby approved. Reason: To ensure the proper provision of surface water drainage and to ensure flooding is not exacerbated in the locality in accordance with Policy EP4 of the South Oxfordshire Local Plan 2035.

Unless otherwise agreed in writing by the Local Planning Authority the full foul water drainage scheme shall be implemented in accordance with the details approved under application P21/S1335/DIS prior to the occupation of the development hereby approved. Reason: To ensure the proper provision of foul water drainage and to ensure flooding and pollution is not exacerbated in the locality in accordance with policy EP4 of the South Oxfordshire Local Plan 2035.

The development hereby approved shall be implemented strictly in accordance with all the measures stated in section 5 of the supporting Ecology and Protected Species Appraisal (James Johnston Ecology, 28/10/2019) submitted under application P20/S0183/FUL. Reason: To protect the important species on the site, in accordance with Policies ENV2 and ENV3 of the South Oxfordshire Local Plan 2035.

Prior to the first occupation of the development hereby approved, the parking and turning areas shall be provided in accordance with the approved plan 0089-GA-0002-P03 and shall be constructed, laid out, surfaced, drained and completed to be compliant with sustainable drainage (SuDS) principles, and shall be retained unobstructed except for the parking of vehicles associated with the development at all times. Reason: In the interests of highway safety and in accordance with Policy TRANS5 of the South Oxfordshire Local Plan 2035.

That the buildings specified in the application to be demolished as shown on drawings PL-08 and PL-09 submitted with application P20/S0183/FUL shall be demolished prior to the first occupation of the new dwelling hereby permitted. Reason: To ensure satisfactory comprehensive development in accordance with Policies DES1, DES2, ENV1 and ENV7 of the South Oxfordshire Local Plan 2035.

Notwithstanding the provisions of the Town and Country Planning (General Permitted Development) Order 2015 (or any Order revoking or re-enacting that Order), the enlargement, improvement or other alteration of the dwelling hereby approved as described in Schedule 2, Part 1, Class A of the Order shall not be undertaken without obtaining planning permission from the Local Planning Authority. Reason: To ensure the Local Planning Authority retains control over any future development as specified in the condition in the interests of the visual appearance of the development in accordance with Policies DES1, DES2 and ENV1 South Oxfordshire Local Plan 2035
