On the basis of the submitted and available information, and on the balance of probability, the District Council is satisfied that the property known as Melhuish Farm, Wallingford Road, North Moreton, OX11 9BA has been continuously occupied in breach of condition four of planning permission SO/W/584/81/O for a period of at least ten years before the application date. As such, the continued occupation in breach of this condition is lawful by virtue of Section 191 of the Town and Country Planning Act 1990 (as amended) as the time limit for which enforcement action could be taken has passed in accordance with Section 171B of the Act.
