Conditions / Refusal Reasons
The available evidence on the balance of probability is consistent with the owner's claim that the building edged in red on the plan accompanying the application has been occupied as three single self contained dwelling houses known as Flat 71a, Flat 71b, and Studio flat 71c for a continuous and uninterrupted period of more than 4 years prior to the date of the application. This use is therefore immune from enforcement action under S.171B of the Town and Country Planning Act 1990 (the Act) and is therefore lawful within the meaning of S.191 of the Act
Appeal
No appeal lodged.
