Reason: To secure the proper planning of the area in accordance with Development Plan policies.
The development shall be carried out in accordance with the materials shown on the materials schedule (including schedule of materials, photographic montage and Instock brick electronic sample) prepared by QP Architecture (P19/S4482/FUL) which includes 1) Main Facing Brick: Instock Audley Red Mixture Stock 2) Feature detail brick: Ibstock Cooksbridge Rustic Blend 3) Stone walling: Bekstone Oolite Cream 4) Tile Hanging 5) Roofing: Blue/grey reproduction slate.
Reason: In the interests of the visual appearance of the development in accordance with Policy DES 1 (Delivering High Quality Development and DES2 (Enhancing Local Character) of the South Oxfordshire Local Plan 2035.
Prior to the first occupation of the development hereby permitted, details of all boundary walls, fences and any other means of enclosure shall be submitted to and approved in writing by the Local Planning Authority . All such approved means of enclosure shall be erected prior to the first occupation of the development.
Reason: In the interests of the visual appearance of the development in accordance with Policy DES 1 (Delivering High Quality Development and DES2 (Enhancing Local Character) of the South Oxfordshire Local Plan 2035.
The development shall be carried out in accordance with the Landscaping scheme shown on drawing KL.358.002 Rev P3 including the retention of trees and hedging as shown. The scheme shall be implemented prior to the first occupation or use of the development hereby approved, or within the first available planting season following completion of the development, and thereafter be maintained in accordance with the approved scheme. In the event of any of the trees or shrubs so planted dying or being seriously damaged or destroyed within 5 years of the completion of the development, a new tree or shrub or equivalent number of trees or shrubs, as the case may be, of a species first approved by the Local Planning Authority, shall be planted and properly maintained in a position or positions first approved in writing by the Local Planning Authority.
Reason: To help to assimilate the development into its surroundings in accordance with Policies ENV1 (Landscape and Countryside) STRAT 1 (Overall Strategy), DES 1 (Delivering High Quality Development) of the South Oxfordshire Local Plan 2035.
Prior to the first occupation of the development, a landscape management plan, including management responsibilities and maintenance schedules, including details of soil handling, for all landscape areas shall be submitted to and approved in writing by the Local Planning Authority. The landscape management plan shall be carried out as approved.
Reason: To help to assimilate the development into its surroundings in accordance with Policies ENV1 (Landscape and Countryside) STRAT 1 (Overall Strategy), DES 1 (Delivering High Quality Development) of the South Oxfordshire Local Plan 2035.
The development shall be carried out in accordance with the tree protection details shown on the Arboricultural Method Statement prepared by Tim Moya Associates submitted as part of application P21/S0118/DIS.
Thereafter the development shall be carried out in accordance with the approved details with the agreed measures being kept in place during the entire course of development.
Reason: To safeguard trees which are visually important in accordance with Policies ENV1 (Landscape and Countryside) STRAT 1 (Overall Strategy), DES 1 (Delivering High Quality Development) of the South Oxfordshire Local Plan 2035.
The development shall be carried out in accordance with the site licence approved by Natural England and confirmed in an email dated 05/01/2021 which was submitted under application P21/S0118/DIS or continued evidence of the successful receipt of a European protected species licence, or evidence of the successful registration of the site under the bat mitigation class licence, from Natural England, specific to this development, which has been submitted to the local planning authority.
Reason: To protect the important species on site, in accordance with Policies ENV1 (Landscape and Countryside), ENV2 (Biodiversity) and ENV3 (Biodiversity - designated sites, priority habitats and species) of the South Oxfordshire Local Plan 2035.
The development hereby approved shall be implemented strictly in accordance with the following details approved under condition 2 above:
- Sections 5, 6 and 7 of the supporting Updated Bat Surveys Report (Middlemarch Environmental Ltd, 28/11/2019, Report No: RT-MME-15027401); - Section 6 of the supporting Badger Survey Report (Middlemarch Environmental Ltd, 29/11/2019, Report No: RT-MME-128574-02); - Sections 3, 4 and 5 of the supporting Reptile Mitigation Strategy (Middlemarch Environmental Ltd, 17/02/2020, Revision A, Report No: RT-MME-128574-01 (Rev A)).
For the avoidance of doubt, this condition requires the reptile receptor area in the south of the site to be created and established for at least one growing season prior to the trapping and translocation exercise outlined in the approved Reptile Mitigation Strategy.
Reason: To minimise the impacts of development on biodiversity, in accordance with Policies ENV1 (Landscape and Countryside), ENV2 (Biodiversity) and ENV3 (Biodiversity - designated sites, priority habitats and species) of the South Oxfordshire Local Plan 2035 and paragraph 170 of the NPPF.
Prior to the first occupation of the development hereby approved details of refuse and recycling storage shall be submitted to and approved in writing by the Local Planning Authority. The refuse and recycling storage shall be implemented in accordance with the approved details prior to the occupation of the development hereby approved and retained thereafter.
Reason: To ensure adequate provision for the management of waste in accordance with Policy INF1 (Infrastructure Provision) of the South Oxfordshire Local Plan 2035.
Prior to occupation of the site, the existing means of access for the current 5 Park Hill, shall be improved and laid out and constructed to the approval of the Local Planning Authority and in accordance with the local highway authority's specifications and all ancillary works specified shall be undertaken.
Reason: In the interest of highway safety in accordance with Policy TRANS5 (Consideration of Development Proposals) of the South Oxfordshire Local Plan 2035.
Before the proposed access is first used, the existing accesses associated with 1 and 3 Park Hill, shall be permanently stopped up by the means of reinstatement of the highway verge and proposed planting to the approval of the Local Planning Authority and in accordance with the local highway authority's specifications. Thereafter the closed access shall not be used by any vehicular traffic whatsoever.
Reason: In the interest of highway safety in accordance with Policy TRANS5 (Consideration of Development Proposals) of the South Oxfordshire Local Plan 2035.
Prior to occupation of the development, or in accordance with a programme of implementation agreed in writing with the Local Planning Authority, the approved highway works shall be implemented in full. These will include:
· A bus shelter associated with the southbound bus stop on Holloway Road; and
· An uncontrolled pedestrian crossing point on Holloway Road to the south of the mini-roundabout.
Reason: In the interest of highway safety in accordance with Policy TRANS5 (Consideration of Development Proposals) of the South Oxfordshire Local Plan 2035.
Prior to the first occupation of the development hereby approved, the parking and turning areas shall be provided in accordance with the approved plan FS468-117F Site Plan and shall be constructed, laid out, surfaced, drained and completed to be compliant with sustainable drainage (SuDS) principles, and shall be retained unobstructed except for the parking of vehicles associated with the development at all times.
Reason: In the interests of highway safety and in accordance with Policy TRANS5 (Consideration of Development Proposals) of the South Oxfordshire Local Plan 2035.
The vision splays shown on the approved plans numbered PB9749-RHD-GE-XX-SK-R-0001 Rev P01 and PB9749-RHD-GE-XX-SK-R-0002 Rev P01 shall be implemented in accordance with the plans and maintained in perpetuity without obstruction.
Reason: In the interest of highway safety in accordance with Policy TRANS5 (Consideration of Development Proposals) of the South Oxfordshire Local Plan 2035.
Prior to the occupation of the development hereby permitted, details of cycle parking facilities shall be submitted to and approved in writing by the Local Planning Authority. The approved cycle parking shall be provided prior to the occupation of the development hereby approved, and retained thereafter.
Reason: To encourage the use of cycles as a means of transport in accordance with Policy TRANS5 (Consideration of Development Proposals) of the South Oxfordshire Local Plan 2035.
Prior to the use of the development hereby permitted a Green Travel Plan shall be drawn up, and submitted to and approved in writing by the Local Planning Authority; such plans to include proposals for all travel by modes other than the private car for journeys to and from site. The development hereby permitted shall be operated in accordance with the approved travel plan.
Reason: To promote the use of non car modes of transport in accordance with Policy TRANS4 (Transport Assessments, Transport Statements and Travel Plans) of the South Oxfordshire Local Plan 2035.
The development shall be carried out in accordance with the Construction Method Statement and Traffic Management Plan dated December 2020 which was submitted as part of application P21/S0118/DIS. Thereafter the approved Statement shall be complied with throughout the demolition and construction period.
Reason: To protect the occupants of nearby residential properties from noise disturbance in accordance with Policy EP2 of the South Oxfordshire Local Plan 2011.
The hours of operation for construction and demolition works shall be restricted to 08:00-18:00 Monday to Friday and 08:00-13:00 on a Saturday. No work is permitted to take place on Sundays or Public Holidays without the prior written authority of the Local Planning Authority.
Reason: To protect the occupants of nearby residential properties from noise disturbance in accordance with Policy ENV12 (Pollution) of the South Oxfordshire Local Plan 2035.
The development shall be carried out in accordance with the Construction Method Statement and Traffic Management Plan dated December 2020 which was submitted as part of application P21/S0118/DIS. Thereafter, the approved Statement shall be complied with throughout the demolition and construction period. The approved CTMP implemented prior to any works being carried out on site, and shall be maintained throughout the course of the development.
Reason: In the interests of highway safety and to mitigate the impact of construction vehicles on the surrounding highway network, road infrastructure and local residents, particularly at morning and afternoon peak traffic times and in accordance with Policy TRANS5 (Consideration of Development Proposals) of the South Oxfordshire Local Plan 2035.
Any gates provided shall be set back a minimum of 5.0 metres from the edge of the carriageway and shall open inwards into the site.
Reason: To ensure that vehicles may wait clear of the highway while the gates are opened or closed in the interests of highway safety in accordance with Policy TRANS5 (Consideration of Development Proposals) of the South Oxfordshire Local Plan 2035.
Prior to the first occupation of the development hereby approved, a scheme to provide Electric Vehicle Charging Points shall be submitted to and approved in writing by the Local Planning Authority.
Reason: To ensure sustainable forms of transport are provided in accordance with Policy TRANS4 (Transport Assessments, Transport Statements and Travel Plans), Policy TRANS5 (Consideration of Development Proposals), and DES8 (Promoting Sustainable Design) of the South Oxfordshire Local Plan 2035.
The development shall be carried out in accordance with the details shown on plan Drainage Layout drwgno 5974 - 01D, the Cole Easdon Technical Note reference 5974 issue 4 dated March 2021, Pump Station Quote, SEER Monitoring, and details provided in the Thames Water Correspondence submitted as part of application P21/S0176/DIS. The drainage scheme shall be designed to accommodate a 1 in 100 year storm + 40% CC and will be implemented in accordance with the approved details prior to the construction of the development hereby approved.
Reason: To prevent pollution and flooding in accordance with Policies ENV11, ENV12 (Pollution) INF4 (Water Resources) and EP4 (Flood Risk) of the South Oxfordshire Local Plan 2035.
The development shall be carried out in accordance with the details shown on plan Drainage Layout drwgno 5974 - 01D, the Cole Easdon Technical Note reference 5974 issue 4 dated March 2021, Pump Station Quote, SEER Monitoring, and details provided in the Thames Water Correspondence submitted as part of application P21/S0176/DIS. The drainage scheme shall be designed to accommodate a 1 in 100 year storm + 40% CC and will be implemented in accordance with the approved details prior to the construction of the development hereby approved.
Reason: To prevent pollution in accordance with Policies ENV11, ENV12 (Pollution), INF4 (Water Resources) and EP4 (Flood Risk) of the South Oxfordshire Local Plan 2035.
The development hereby approved shall be designed, constructed and maintained to meet the acoustic requirements specified in section 5 of the acoustic report by MEC reference 24226/08-18/6130 REV A dated November 2019.
Reason: To safeguard the amenities of residents of nearby properties in accordance with Policy ENV11 and ENV12 (Pollution) of the South Oxfordshire Local Plan 2035.
