Conditions / Refusal Reasons
The development to which this permission relates must be begun not later than the expiration of three years beginning with the date of this permission.
Reason: By virtue of Sections 91 to 95 of the Town and Country Planning Act 1990 as amended by section 51 of the Planning and Compulsory Purchase Act 2004.
That the development hereby approved shall be carried out in accordance with the details shown on the following approved plans, HTS-TCP-01A, PhilHLS-1-5-002, PhilHLS-1-5-001 and PhilHLS-1-1-001E, except as controlled or modified by conditions of this permission.
Reason: To secure the proper planning of the area in accordance with Development Plan policies.
The development hereby permitted shall only be constructed in the materials and details specified on the plans and supporting documents hereby approved unless otherwise expressed by other conditions of this permission, or in materials and details which shall previously have been approved in writing by the Local Planning Authority.
Reason: In the interests of the visual appearance of the development and special character of The River Thames in accordance with Policies STRAT1, ENV1, ENV4, DES1 and DES2 of the South Oxfordshire Local Plan 2035.
The tree protection details and measures (Tree Root Geocellular Compaction Protection) as shown on the Proposed Site Plan and set out at sections 3.9 and 3.10 of Planning Statement Apr 2022 (vr2 May 2022) hereby approved, must be installed prior to the commencement of all works and remain in place for the duration of the development. All machinery must operate from the Geocellular Compaction Protection Area and all materials must be stored on it, to ensure the adjacent trees root protection areas are protected during construction.
Reason: To safeguard trees which are visually important in accordance with Policies STRAT1, ENV1, ENV4, DES1, and DES2 of the South Oxfordshire Local Plan 2035.
Prior to the commencement of the development hereby approved a detailed scheme for the planting of live trees, shrubs and specification of the coir pallets, shall be submitted to and approved in writing by the Local Planning Authority. These details shall include schedules of new trees and shrubs to be planted and a full specification and planting details of the coir pallets (noting species, plant sizes and numbers/densities), the identification of the existing trees, shrubs and root balls on the site to be retained (noting species, location and spread), any earth moving operations and finished levels/contours, and an implementation programme.
The scheme shall be implemented prior to the first use of the development hereby approved and thereafter be maintained in accordance with the approved scheme. In the event of the retained willow root ball and / or any of the trees or shrubs so planted dying or being seriously damaged or destroyed within 5 years of the completion of the development, replacement planting and works to shore the river bank shall be undertaken in accordance with a scheme which shall first have been submitted to, and approved in writing by the Local Planning Authority.
Reason: In the interests of the visual appearance of the development and special character of The River Thames in accordance with Policies STRAT1, ENV1, ENV4, DES1 and DES2 of the South Oxfordshire Local Plan 2035.
Prior to the commencement of the development hereby approved, a detailed scheme for the new bird nesting box shall be submitted to and approved in writing by the Local Planning Authority. These details shall include a full specification of the proposed bird boxes, their location, height and orientation. The scheme shall be implemented prior to the first use of the development hereby approved and thereafter be maintained in accordance with the approved scheme. In the event of the bird boxes being seriously damaged or destroyed within 5 years of the completion of the development, replacement nesting boxes shall be installed, in accordance with a scheme which shall first have been submitted to, and approved in writing by the Local Planning Authority.
Reason: To ensure that there is no net loss of biodiversity, in accordance with Policies STRAT1, ENV2, ENV3 and ENV4 of the South Oxfordshire Local Plan 2035.
