Variation of condition 9 on planning application P16/S3284/O - to allow the final, decorative surfacing of the vehicular accesses and turning areas which serve those dwellings to take place after the occupation of initial dwellings
Outline planning application for erection of up to 140 dwellings, new public open space, associated landscaping and site infrastructure.
Conditions / Refusal Reasons
Details of the access, appearance, landscaping, layout, and scale, shall be carried out in accordance with the details approved under application P19/S4178/RM.
Reason: The application has been made in outline and is not accompanied by the details of these reserved matters.
This condition is blank in order to retain the same numbering as the conditions on P16/S3284/O.
The development hereby permitted shall commence not later than 9 December 2022.
Reason: By virtue of Sections 91 to 95 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004.
That the development hereby approved shall be carried out in accordance with the details shown on the following approved plans, 15.240-LP-01 Rev A and 15.240-LP-02 Rev A, 15.240/P401 Rev C, 15.240/P403 Rev C and 15.240/P402 Rev B, except as controlled or modified by conditions of this permission.
Reason: To secure the proper planning of the area in accordance with Development Plan policies.
The mix of dwelling types and sizes shall be in accordance with the details approved under application P19/S4079/DIS.
Reason: In accordance with Policy H11 of the South Oxfordshire Local Plan 2035.
The slab levels of the buildings in relation to the existing and proposed levels of the site and surrounding land shall be constructed in accordance with the details approved under application P19/S4079/DIS, or as approved under any subsequent application for the approval of details reserved by condition.
Reason: In the interests of the visual appearance of the development in accordance with Policies DES1 and DES2 of the South Oxfordshire Local Plan 2035 and Policy CH C1 of the Chinnor Neighbourhood Plan 2011-2034.
The sustainable travel initiatives outlined in the Full Travel Plan approved under application P19/S4079/DIS shall be implemented in accordance with the details and timeframes outlined in this document.
Reason: To promote the use of non car modes of transport in accordance with Policy TRANS4 of the South Oxfordshire Local Plan 2035.
The development shall be carried out in accordance with the Construction Traffic Management Plan approved under application P19/S3234/DIS.
Reason: In the interests of highway safety and to mitigate the impact of construction vehicles on the surrounding highway network, road infrastructure and local residents, particularly at morning and afternoon peak traffic times and in accordance with Policy TRANS5 of the South Oxfordshire Local Plan 2035.
Before any of the dwellings hereby permitted are first occupied, the proposed vehicular accesses, driveways and turning areas that serve those dwellings shall be constructed, laid out, surfaced to at least binder course and drained in accordance with the specification details that shall have been first submitted to and approved in writing by the Local Planning Authority. Final surfacing of all vehicular accesses, driveways and turning areas must take place prior to the final occupation.
Reason: In the interests of highway safety and to ensure a satisfactory standard of construction and layout for the development in accordance with Policy TRANS5 of the South Oxfordshire Local Plan 2035.
The development shall be implemented in accordance with the Written Scheme of Investigation for a Programme of Archaeological Evaluation approved application P19/S3234/DIS.
Reason: To secure the protection of and proper provision for any archaeological remains in accordance with Policy ENV9 of the South Oxfordshire Local Plan 2035 and Policy CH H3 of the Chinnor Neighbourhood Development Plan 2011-2034.
Prior to any demolition on the site and the commencement of the development (other than in accordance with the agreed Written Scheme of Investigation), a staged programme of archaeological evaluation and mitigation shall be carried out by the commissioned archaeological organisation in accordance with the approved Written Scheme of Investigation. The programme of work shall include all processing, research and analysis necessary to produce an accessible and useable archive and a full report for publication which shall be submitted to the Local Planning Authority.
Reason: To enable an appropriate level of archaeological investigation of the area including excavation and recording, post excavation analysis and the publication of results in accordance with Policy ENV9 of the of the South Oxfordshire Local Plan 2035 and Policy CH H3 of the Chinnor Neighbourhood Development Plan 2011-2034.
Development (with the exception of site preparation and ground works) shall not commence until a drainage strategy detailing any on and off site drainage works, has been submitted to and approved in writing by the Local Planning Authority. No discharge of foul or surface water from the site shall be accepted into the public system until the drainage works referred to in the strategy have been completed.
Reason: To ensure the proper provision of surface water and foul drainage in accordance with Policy EP4 of the South Oxfordshire Local Plan 2035 and Policy CH H8 of the Chinnor Neighbourhood Plan 2011-2034.
The development hereby permitted shall not be occupied until surface water drainage works in accordance with the principles of sustainable urban drainage (SUDS) have been carried out in accordance with details that have been first submitted to and approved in writing by the Local Planning Authority.
Reason: To prevent pollution and flooding in accordance with Policies ENV12 and EP4 of the South Oxfordshire Local Plan 2035 and Policy CH H8 of the Chinnor Neighbourhood Plan 2011-2034
The development shall be carried out in accordance with the Arboricultural Method Statement and associated plans as approved under application P19/S4079/DIS.
Reason: To safeguard trees which are visually important in accordance with Policies ENV1, DES1, and DES2 of the South Oxfordshire Local Plan 2035 and Policy CH GP2 of the Chinnor Neighbourhood Plan 2011-2034.
The site shall be managed in accordance with the Landscape Management Plan and associated plans approved under application P19/S4079/DIS.
Reason: To help to assimilate the development into its surroundings in accordance with Policies ENV1, DES1 and DES2 of the South Oxfordshire Local Plan 2035 and Policy CH GP2 of the Chinnor Neighbourhood Plan 2011-2034.
The development shall be carried out in accordance with the mitigation measures outlined in the Noise Impact Assessment approved under application P19/S4079/DIS.
Reason: To protect future occupiers from noise disturbance in accordance with Policies ENV12 of the South Oxfordshire Local Plan 2035.
The development shall be carried out in accordance with the odour and pollution mitigation measures outlined in the Odour and Pollutant Mitigation Strategy approved under application P19/S4079/DIS.
Reason: To protect future occupiers from odour disturbance in accordance with Policy ENV12 of the South Oxfordshire Local Plan 2035.
The development shall be carried out in accordance with the mitigation measures outlined in the Air Quality Mitigation Statement and associated plan approved under application P19/S4079/DIS.
Reason: Due to the location and the size of the approved development and the sensitivities within the area to ensure satisfactory standards of air quality for future residents of the approved development and surrounding residential properties in accordance with Policy EP1 of the a South Oxfordshire Local Plan 2035.
The development shall be carried out in accordance with the recommendations in the Geo- Environmental report approved under application P20/S0667/DIS.
Reason: To ensure that any ground, water and associated gas contamination is identified and adequately addressed to ensure the safety of the development, the environment and to ensure the site is suitable for the proposed use in accordance with Policy ENV11 of the South Oxfordshire Local Plan 2035.
The development shall not be occupied until any previously approved remediation strategy has been carried out in full and a validation report confirming completion of these works has been submitted to and approved in writing by the Local Planning Authority.
Reason: To ensure that any ground, water and associated gas contamination is identified and adequately addressed to ensure the safety of the development, the environment and to ensure the site is suitable for the proposed use in accordance with Policy ENV11 of the South Oxfordshire Local Plan 2035.
In connection with the implementation of this permission no construction works shall take place outside the hours of 07:30 to 18:00 Mondays to Fridays and 08:00 to 13:00 on Saturdays. Works shall not take place at all on Sundays or Bank Holidays without the prior written authority of the Local Planning Authority.
Reason: To ensure that the development is not unneighbourly in accordance with Policy DES6 of the South Oxfordshire Local Plan 2035.
Prior to first occupation details of the means by which the dwellings hereby approved may be connected to the utilities to be provided on site to facilitate super-fast broadband connectivity shall be submitted to and approved in writing by the Local Planning Authority. The development shall be carried out in accordance with the approved details.
Reason: In the interests of providing sustainable living environments, to promote home working, reduce the need to travel and to mitigate any impacts on air pollution in accordance with Policy EP1 of the South Oxfordshire Local Plan 2035.
No dwelling shall be occupied until details of the layout and equipment to be included in the children's play space, and a timetable for their implementation, have been submitted to and approved in writing by the Local Planning Authority. The play space shall be implemented in accordance with the approved details and be maintained thereafter.
Reason: To meet the need for children's play space in accordance with Policy INF1 of the South Oxfordshire Local Plan 2035.
