Conditions / Refusal Reasons
The development to which this permission relates must be begun not later than the expiration of three years beginning with the date of this permission.
Reason: By virtue of Sections 91 to 95 of the Town and Country Planning Act 1990 as amended by section 51 of the Planning and Compulsory Purchase Act 2004.
That the development hereby approved shall be carried out in accordance with the details shown on the following approved plans, 200731_001, 200731_000, 200731_200_2, 200731_201_2 and 200731_202_2, except as controlled or modified by conditions of this permission.
Reason: To secure the proper planning of the area in accordance with Development Plan policies.
That those buildings shown to be demolished on the plans accompanying the application shall be demolished, and any demolished material which is not to be utilised in the new development shall be removed from the land, before the development hereby permitted commences, and this provision shall apply unless an alternative scheme for the phased demolition of the building(s) and removal of materials is first submitted to and approved in writing by the Local Planning Authority.
Reason: To ensure satisfactory comprehensive development and in the interests of the visual appearance, in accordance with Policies CS1, CSEN1, CSEN3 and CSQ3 of the South Oxfordshire Core Strategy 2027 and Policies C4, D1, G2, G4 and H13 of the South Oxfordshire Local Plan 2011.
The outbuilding hereby permitted shall be single storey (with accommodation permitted in the roof) and it's ridge and eaves height shall not exceed 155.634 and 151.984 respectively, relative to a fixed datum point as shown on approved plans 200731_001 and 200731_202_2, or in heights which shall have previously been approved in writing by the Local Planning Authority.
Reason: In the interests of the visual appearance of the development in accordance with Policies CS1, CSEN1, CSEN3 and CSQ3 of the South Oxfordshire Core Strategy 2027 and Policies C4, D1, G2, G4 and H13 of the South Oxfordshire Local Plan 2011.
The exterior of the development hereby permitted shall only be constructed in the materials specified on the plans hereby approved or in materials which shall previously have been approved in writing by the Local Planning Authority.
Reason: In the interests of the visual appearance of the development in accordance with Policies CS1, CSEN1, CSEN3 and CSQ3 of the South Oxfordshire Core Strategy 2027 and Policies C4, D1, G2, G4 and H13 of the South Oxfordshire Local Plan 2011.
The rooflights hereby approved shall be set flush with the plane of the roof in which they are to be inserted.
Reason: In the interests of the visual appearance of the development in accordance with Policies CS1, CSEN1, CSEN3 and CSQ3 of the South Oxfordshire Core Strategy 2027 and Policies C4, D1, G2, G4 and H13 of the South Oxfordshire Local Plan 2011.
Any external lighting will only be permitted in accordance with a lighting scheme to be submitted to and approved in writing by the Local Planning Authority prior to the first occupation of the development hereby approved. Any such lighting shall be implemented in accordance with the approved details and directed downwards to prevent nuisance to adjoining residential occupiers from light spillage.
Reason: To protect the appearance of the area, the environment and wildlife, and local residents from light pollution in accordance with Policies CS1, CSB1, CSEN1, CSEN3 and CSQ3 of the South Oxfordshire Core Strategy 2027 and Policies C4, C6, C7, C8, D1, EP3, G2, G4 and H13 of the South Oxfordshire Local Plan 2011.
The development hereby permitted shall not be occupied at any time other than for purposes ancillary to the residential use of the dwelling known as Beechwood Cottage.
Reason: As the separate occupation of the accommodation would represent an undesirable sub-division of the property and result in inadequate standards of amenity and privacy in accordance with Policy H13 of the South Oxfordshire Local Plan 2011.
The garage accommodation hereby approved shall be retained as such and shall not be adapted for living purposes without planning permission from the Local Planning Authority.
Reason: To ensure the Local Planning Authority has control over any future extensions to the ancillary living accommodation at the site, as the separate occupation of the accommodation would represent an undesirable sub-division of the property and result in inadequate standards of amenity and privacy in accordance with Policy H13 of the South Oxfordshire Local Plan 2011.
