Conditions / Refusal Reasons
The development to which this permission relates must be begun not later than the expiration of three years beginning with the date of this permission. Reason: By virtue of Sections 91 to 95 of the Town and Country Planning Act 1990 as amended by section 51 of the Planning and Compulsory Purchase Act 2004.

That the development hereby approved shall be carried out in accordance with the details shown on the following approved plans, 853.1, PA 103 Rev A, AEL-18224-TCNLP, PA101, PA102 Rev C, AEL-18224-TCP, AEL-18224-TIP, AEL-18224-NTP, AEL-18224-TPP, AEL-18224-TSP and AEL-18224-TWP, except as controlled or modified by conditions of this permission. Reason: To secure the proper planning of the area in accordance with Development Plan policies.

The exterior of the development hereby permitted shall only be constructed in the materials specified on the plans hereby approved or in materials which shall previously have been approved in writing by the Local Planning Authority. Reason: In the interests of the visual appearance of the development in accordance with Policies CSEN1 and CSQ3 of the South Oxfordshire Core Strategy 2027 and Policies D1, G2 and H4 of the South Oxfordshire Local Plan 2011.

Prior to first occupation of the development hereby approved, the existing means of access onto Constitution Hill shall be improved and laid out and constructed strictly in accordance with the local highway authority's specifications and all ancillary works specified shall be undertaken. Reason: In the interest of highway safety in accordance with Policy T1 of the South Oxfordshire Local Plan 2011.

The vision splays shown on the approved plan PA102 Rev C shall not be obstructed by any object, structure, planting or other material with a height exceeding or growing above 0.9 metres as measured from carriageway level. Reason: In the interest of highway safety in accordance with Policy T1 of the South Oxfordshire Local Plan 2011.

Prior to the first occupation of the development hereby approved, the parking and turning areas shall be provided in accordance with the approved plan PA102 Rev C and shall be constructed, laid out, surfaced, drained and completed to be compliant with sustainable drainage (SuDS) principles, and shall be retained unobstructed except for the parking of vehicles associated with the development at all times. Reason: In the interests of highway safety and in accordance with Policies T1 and T2 of the South Oxfordshire Local Plan 2011.

Any gates provided shall be set back a minimum of 5.0 metres from the edge of the carriageway and shall open inwards into the site. Reason: To ensure that vehicles may wait clear of the highway while the gates are opened or closed in the interests of highway safety in accordance with Policy T1 of the South Oxfordshire Local Plan 2011.

That a scheme for the landscaping of the site, including the planting of live trees, hedges and shrubs and hard surfacing and means of enclosure, shall be submitted to and approved in writing by the Local Planning Authority prior to the occupation of the development hereby permitted. The scheme shall be implemented in full within 2 months of the first occupation or use as approved of the new dwelling and thereafter shall be maintained in accordance with the approved scheme. In the event of any of the trees, hedges or shrubs so planted dying or being seriously damaged or destroyed within 5 years of the completion of the development, a new tree or shrub or equivalent number of trees or shrubs, as the case may be, of a species first approved by the Local Planning Authority, shall be planted and properly maintained in a position or positions first approved in writing by the Local Planning Authority. Reason: To help to assimilate the development into its surroundings in accordance with Policies CSEN1 and CSQ3 of the South Oxfordshire Core Strategy 2027 and Policies C9, D1 and G2 of the South Oxfordshire Local Plan 2011.

Prior to the commencement of any site works (including demolition or site clearance) a protected area shall be designated for all existing trees which are shown to be retained, and the trees shall be protected in accordance with a scheme which complies with the current edition of BS 5837: "Trees in relation to design, demolition and construction" that shall first have been submitted to, and approved in writing by, the Local Planning Authority. The agreed measures shall be kept in place during the entire course of development. Reason: To safeguard trees which are visually important in accordance with Policies CSEN1 and CSQ3 of the South Oxfordshire Core Strategy 2027 and Policies C9, D1 and G2 of the South Oxfordshire Local Plan 2011.

Prior to the commencement of development other than demolition of the existing building, a full surface water drainage scheme shall be submitted to and approved in writing by the Local Planning Authority. The scheme shall include details of the size, position and construction of the drainage scheme and results of soakage tests carried out at the site to demonstrate the infiltration rate. Three tests should be carried out for each soakage pit as per BRE 365 with the lowest infiltration rate (expressed in m/s) used for design. An exceedance plan shall be submitted. The development shall be carried out in accordance with the approved details prior to the first occupation of the development hereby approved. Reason: To ensure the proper provision for surface water drainage and to ensure flooding is not exacerbated in the locality in accordance with the National Planning Policy Framework and Planning Practice Guidance.

That, prior to the commencement of development other than demolition of the existing building, a full foul water drainage scheme shall be submitted to and approved in writing by the Local Planning Authority. The scheme shall include details of the size, position and construction of the drainage scheme, all coupled with calculations to evidence this. The development shall be carried out in accordance with the approved details prior to the first occupation of the development hereby approved. Reason: To prevent pollution in accordance with Policy EP1 of the South Oxfordshire Local Plan 2011.

Prior to the commencement of the development hereby approved, evidence of the successful registration of the site under the bat mitigation class licence, from Natural England, specific to this development, shall be submitted to and approved in writing by the local planning authority. Reason: To protect the important species on site, in accordance with Policies C6 and C8 of the SOLP, Policy CSB1 of the SOCS and paragraph 170 of the NPPF.

The development hereby approved shall be implemented strictly in accordance with the recommendations made in section 6 of the supporting Protected Species Survey Report (Windrush Ecology Ltd, 07/04/2020, Ref: W3681_rep_New Barn, Mongewell_07-04-20) and provide the ecological features shown on drawing: PA 103 A. Reason: To minimise the impacts of development on biodiversity, in accordance with Policies C6 and C8 of the SOLP, Policy CSB1 of the SOCS and paragraph 170 of the NPPF.
