Reserved Matters application following outline planning permission P16/S4079/O (Erection of seven detached and semi-detached two-storey dwellings together with access, parking and amenity space) seeking approval of matters of appearance, landscaping and scale (additional landscaping details provided as shown on amended plans received 1st April 2020 and photographs of existing boundary planting to be retained received 21st April 2020 and alterations to landscaping detail as shown on amended plans received 8th July 2020).
Conditions / Refusal Reasons
That the development hereby approved shall be carried out in accordance with the details shown on the following approved plans, 03, 04, 05A, 06A, 07A, 02A, P100, 14632-LD-01E and 01D, except as controlled or modified by conditions of this permission.
Reason: To secure the proper planning of the area in accordance with Development Plan policies.
The development hereby permitted shall begin no later than two years from the date of approval of the last of the reserved matters to be approved.
Reason: By virtue of Section 91 to 95 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004.
The exterior of the development hereby permitted shall only be constructed in the materials specified on the Planning Statement and email dated 29th July 2020 hereby approved or in materials which shall previously have been approved in writing by the Local Planning Authority.
Reason: In the interests of the visual appearance of the development in accordance with Policy CSQ3 of the South Oxfordshire Core Strategy 2027 and Policies G2 and D1 of the South Oxfordshire Local Plan 2011.
The first floor windows in the north-east and south-west facing side elevations serving a stairwell and en-suite of Plots 3 & 4 and landing and en-suite of Plots 6 & 7 and landing, en-suite and bedroom 3 of Plot 5 hereby permitted shall be glazed in obscure glass with a minimum of level 3 obscurity, and shall be fixed shut with the exception of a top hung openable fanlight, prior to the first occupation of the development and shall be retained as such thereafter.
Reason: To ensure that the development is not unneighbourly in accordance with Policies G2, D4 and H4 of the South Oxfordshire Local Plan 2011.
Notwithstanding the provisions of the Town and Country (General Permitted Development Order) 2015 (or any Order revoking or re-enacting that Order), no development as specified in Schedule 2, Part 1, Class A - Two Storey Rear Extensions (Plot 4); Class B - Roof Extensions (Plot 4); Class E - Outbuildings (Plot 4); Class F- Hardstandings on front garden areas (Plots 1-7) and Area G shown on approved plan 14632-LD-01E shall be undertaken without obtaining planning permission from the Local Planning Authority.
Reason: The specific circumstances of this site warrant the Local Planning Authority having control over any further development as specified in the condition in the interests of visual amenity and the residential amenity of No.50 Elderdene in accordance with Policies CSQ3 and CSEN1 of the South Oxfordshire Core Strategy 2027 and Policies G2, D1 and H4 of the South Oxfordshire Local Plan 2011.
The landscaping scheme as shown on the approved plan 14632-LD-01E shall be implemented prior to the first occupation or use of the approved development and thereafter be maintained in accordance with the approved landscaping maintenance schedule 14632-LD-02. In the event of any of the trees or shrubs so planted dying or being seriously damaged or destroyed within 5 years of the completion of the development, a new tree or shrub or equivalent number of trees or shrubs, as the case may be, of a species first approved by the Local Planning Authority, shall be planted and properly maintained in a position or positions first approved in writing by the Local Planning Authority.
Reason: To help to assimilate the development into its surroundings in accordance with Policies CSEN1 and CSQ3 of the South Oxfordshire Core Strategy 2027 and Policies G2, C9 and D1 of the South Oxfordshire Local Plan 2011.
