Installation of x2 110mm push fit telecoms duct in public footpath crossing Henley Regatta bridge (As per additional plans and amended information clarifying the depth of the proposed cabling and location of the trail holes, submitted 17 December 2020).
Conditions / Refusal Reasons
The works hereby permitted shall be begun not later than three years from the date of this consent.
Reason: To comply with the provisions of section 18(1) of the Planning (Listed Buildings and Conservation Areas) Act 1990 as amended by section 51 of the Planning and Compulsory Purchase Act 2004.
That the works hereby approved shall be carried out in accordance with the details shown on the following approved plans, CC11003_TEND_CHQ_TRXS_000537 1 of 3, CC11003_TEND_CHQ_TRXS_000537 2 of 3, CC11003_TEND_CHQ_TRXS_000537 3 of 3 and 11.BC0471, except as controlled or modified by conditions of this consent.
Reason: To secure the proper planning of the historic environment in accordance with Development Plan policies.
Prior to the commencement of any works, a scheme for the protection of the stonework parapet of the bridge; shall be submitted to and approved in writing by the Local Planning Authority. The approved scheme shall protect the feature(s) whilst the works are carried out and shall be implemented prior to the commencement of any works and retained until the works have been completed.
Reason: To secure the proper planning of the historic environment and to protect the features of the building which are of special historic and architectural importance in accordance with policies ENV6 and ENV7 of the South Oxfordshire Local Plan 2035.
Notwithstanding the approved details, works to remove the existing footpath surface materials (footpath paving and kerb stones) to allow for trenching works; shall be carried out using hand-held tools only (excluding power-driven hand tools), and the materials shall be safely stored, before being re-instated once the laying of cable ducting hereby approved has been completed. Any replacement materials that may be necessary are to match those used on the original bridge including stone type, sizes and dimensions, mortar joints, type, materials and technique unless otherwise agreed writing by the local planning authority prior to the use of the replacement materials.
Reason: To secure the proper planning of the historic environment and safeguard the special architectural or historic interest of the Grade I listed structure in in accordance with policies ENV6 and ENV7 of the South Oxfordshire Local Plan 2035.
Notwithstanding the approved details, works to excavate and form the trench for the ducting; shall be carried out using hand-held tools aside from the removal of the topmost thickness of material directly below the footpath surface material where it is permissible to use power-tools, or in a manner / details which shall have first been submitted to and approved in writing by the local planning authority.
Reason: To secure the proper planning of the historic environment and safeguard the special architectural or historic interest of the Grade I listed structure in in accordance with policies ENV6 and ENV7 of the South Oxfordshire Local Plan 2035.
Should, during the undertaking of the permitted works to install ducting below the bridge's surface, there is damage to the stonework parapet of the bridge and/or the stonework forming the bridge arches or if the latter becomes revealed through excavation, all works on site shall cease with immediate effect and the local planning authority's Conservation Officer notified. Any remedial works required shall then be completed in details which shall have first been submitted to and approved in writing by the local planning authority.
