On the basis of the supporting documents accompanying the application submission, the District Council is satisfied that the building known as '1 Arrowfield Cottages' has, on the balance of probabilities, been in continued use as a residential dwelling for a period of at least 10 years without compliance with the agricultural occupancy condition attached to application ref: P71/H0225. As such, his use is immune from enforcement action under section 171B of the Town and Country Planning Act ('the Act') and therefore lawful within the meaning of Section 191 of the Act.
