Conditions / Refusal Reasons
The development to which this permission relates must be begun not later than the expiration of three years beginning with the date of this permission.
Reason: By virtue of Sections 91 to 95 of the Town and Country Planning Act 1990 as amended by section 51 of the Planning and Compulsory Purchase Act 2004.
That the development hereby approved shall be carried out in accordance with the details shown on the following approved plans, V20-125-SP03_C, V20-125-SP04_C, V20-125-SP01_D, V20-125-SP02_A, V20-125-SP05_B, V20-125-SLP02, V20-125-P01_B and V20-125-SLP01_C, except as controlled or modified by conditions of this permission.
Reason: To secure the proper planning of the area in accordance with Development Plan policies.
That a scheme for the landscaping of the site, including the planting of live trees and shrubs, shall be submitted to and approved in writing by the Local Planning Authority prior to the commencement of the development hereby permitted. The scheme shall be implemented prior to the first occupation or use of the development hereby approved and thereafter be maintained in accordance with the approved scheme. In the event of any of the trees or shrubs so planted dying or being seriously damaged or destroyed within 5 years of the completion of the development, a new tree or shrub or equivalent number of trees or shrubs, as the case may be, of a species first approved by the Local Planning Authority, shall be planted and properly maintained in a position or positions first approved in writing by the Local Planning Authority.
Reason: To help to assimilate the development into its surroundings and rural chracter of the Green Belt in accordance with Policies CSEN1, CSEN2 and CSQ3 of the South Oxfordshire Core Strategy 2012 and Policies G2, C9, D1 and GB4 of the South Oxfordshire Local Plan 2011.
The tree protection details as shown on the approved V20-125-SP05 Rev B shall be put in place prior to any on site works including demolition and thereafter retained in situ for the duration of development.
Reason: To safeguard trees which are visually important in accordance with Policies CSEN1 and CSQ3 of the South Oxfordshire Core Strategy 2027 and Policies G2, C9 and D1 of the South Oxfordshire Local Plan 2011
Prior to the commencement of development above ground slab level, a full surface water drainage scheme, including details of the size, position and construction of drainage works, coupled with PPG measures shall be submitted to, and approved in writing by, the Local Planning Authority. The drainage scheme shall be designed to accommodate a 1 in 10 year storm + 40% CC and shall be implemented in accordance with the approved details prior to the use of the development hereby approved
Reason: To prevent pollution and flooding in accordance with Policies EP1 and EP6 of the South Oxfordshire Local Plan 2011.
That, prior to the commencement of development above ground slab level, a full foul water drainage scheme shall be submitted to and approved in writing by the Local Planning Authority. The scheme shall include details of the size, position and construction of the drainage scheme, all coupled with calculations to evidence this. The development shall be implemented in accordance with the approved details prior to the use of the development hereby approved
Reason: To prevent pollution in accordance with Policy EP1 of the South Oxfordshire Local Plan 2011.
Prior to the first use of the development hereby approved, the parking and turning areas shall be provided in accordance with the approved plan V20-125-SP04 Rev C and shall be constructed, laid out, surfaced, drained and completed to be compliant with sustainable drainage (SuDS) principles, and shall be retained unobstructed except for the parking of vehicles associated with the development at all times.
Reason: In the interests of highway safety and in accordance with Policies T1 and T2 of the South Oxfordshire Local Plan 2011.
The development hereby approved shall be implemented strictly in accordance with all of the recommendations made in section 6 of the supporting Preliminary Ecological Appraisal (Philip Irving, May 2020).
Reason: To minimise the impacts of development on biodiversity, in accordance with Policies C6 and C8 of the South Oxfordshire Local Plan 2011, Policy CSB1 of the South Oxfordshire Core Strategy 2012 and paragraphs 170 and 175 of the NPPF.
The exterior of the development hereby permitted shall only be constructed in the materials specified on the plans hereby approved or in materials which shall previously have been approved in writing by the Local Planning Authority.
Reason: In the interests of the visual appearance of the development in accordance with Policy CSQ3 of the South Oxfordshire Core Strategy 2012 and Policies G2 and D1 of the South Oxfordshire Local Plan 2011.
The stables hereby permitted shall be used only for the keeping of horses for the private leisure purposes of the owner of the land, and shall not be used for any commercial activity.
Reason: To meet the particular needs of the applicant and to avoid the introduction of a commercial use in this rural and inaccessible location in the Green Belt, in accordance with Policies CSS1, CSM1, CSEN2 of the South Oxfordshire Core Strategy 2012 and Policies G2, T1, GB4 and R10 of the South Oxfordshire Local Plan 2011.
No chattels, structures or other equestrian related paraphernalia shall be stationed on the three horse grazing fields as shown on approved drawing V20-125-SP01 Rev D (other than those required for animal feed or water).
Reason: To preserve the openness of the Green Belt in accordance with policy CSEN2 of the South Oxfordshire Core Strategy 2012, policy GB4 of the South Oxfordshire Local Plan 2011 and national policy guidance in National Planning Policy Framework 2019.
No floodlighting shall be erected or stationed on the land without express planning permission from the Local Planning Authority. Any other external lighting (including, but not limited to building security lights) will only be permitted in accordance with a lighting scheme to be submitted to and approved by the Local Planning Authority prior to the first occupation of the development hereby approved. Any such lighting shall be implemented in accordance with the approved details and directed downwards to prevent impact on wildlife.
Reason: To protect the appearance of the area, the environment and wildlife from light pollution in accordance with Policies C6 and C8, EP3 of the South Oxfordshire Local Plan 2011, Policy CSB1 of the South Oxfordshire Core Strategy 2012 and paragraphs 170 and 175 of the NPPF.
