Description
Change of use of agricultural land to allow the siting of two shepherd huts for holiday letting purposes and associated infrastructure (additional landscaping, planting and maintenance details provided as shown on plan submitted 20th March 2020 and ecological method statement received 24th March 2020 and arboricultural method statement received 2nd April 2020).
Conditions / Refusal Reasons
The development to which this permission relates must be begun not later than the expiration of three years beginning with the date of this permission.
Reason: By virtue of Sections 91 to 95 of the Town and Country Planning Act 1990 as amended by section 51 of the Planning and Compulsory Purchase Act 2004.
That the development hereby approved shall be carried out in accordance with the details shown on the following approved plans, KCC2748-06A Rev A, KCC2748-03, KCC2748-05 and KCC2748-04, except as controlled or modified by conditions of this permission.
Reason: To secure the proper planning of the area in accordance with Development Plan policies.
The exterior of the development hereby permitted shall only be constructed in the materials specified on the application forms and supporting statement hereby approved or in materials which shall previously have been approved in writing by the Local Planning Authority.
Reason: In the interests of the visual appearance of the development in accordance with Policies CSEN1 and CSQ3 of the South Oxfordshire Core Strategy 2027 and Policies G2, G4, D1 and TSM5 of the South Oxfordshire Local Plan 2011.
The solar panels hereby approved shall be implemented as a ground-mounted installation only in the location stipulated on the block plan hereby approved and thereafter retained as approved.
Reason: In the interests of the visual appearance of the development in accordance with Policies CSEN1 and CSQ3 of the South Oxfordshire Core Strategy 2027 and Policies G2, G4, D1 and TSM5 of the South Oxfordshire Local Plan 2011.
Prior to the first occupation of the development hereby approved, the access, parking and turning areas shall be provided within the application site area in accordance with the location identified on Page 4 of the submitted supporting statement and shall be retained unobstructed except for the parking of vehicles associated with the development at all times.
Reason: In the interests of highway safety and in accordance with Policies G2, D2, T1, T2 and TSM5 of the South Oxfordshire Local Plan 2011.
The landscaping scheme as shown on the approved Landscaping, Planting and Maintenance Proposals report (Kernon Countryside Consultants Ltd) dated March 2020 shall be implemented prior to the first use of the approved development and thereafter be maintained in accordance with the approved scheme. In the event of any of the trees or shrubs so planted dying or being seriously damaged or destroyed within 5 years of the completion of the development, a new tree or shrub or equivalent number of trees or shrubs, as the case may be, of a species first approved by the Local Planning Authority, shall be planted and properly maintained in a position or positions first approved in writing by the Local Planning Authority.
Reason: To help to assimilate the development into its surroundings in accordance with Policies CSEN1 and CSQ3 of the South Oxfordshire Core Strategy 2027 and Policies G2, G4, C9, D1 and TSM5 of the South Oxfordshire Local Plan 2011.
The tree protection details as shown on the approved Arboricultural Method Statement (Kernon Countryside Consultants Ltd) dated April 2020 shall be put in place prior to any on site works including demolition and thereafter retained in situ for the duration of development.
Reason: To safeguard trees which are visually important in accordance with Policies CSEN1 and CSQ3 of the South Oxfordshire Core Strategy 2027 and Policies G2, G4, C9, D1 and TSM5 of the South Oxfordshire Local Plan 2011.
The proposed tree and hedge planting, where located within the root protection area of the oak tree, shall be carried out by hand held spade.
Reason: To safeguard trees which are visually important in accordance with Policies CSEN1 and CSQ3 of the South Oxfordshire Core Strategy 2027 and Policies G2, G4, C9, D1 and TSM5 of the South Oxfordshire Local Plan 2011.
The development hereby permitted shall be implemented in accordance with the details contained in the herpetofauna method statement (AA Environmental Ltd) dated March 2020 submitted with the application in all respects. Any variation shall be agreed in writing by the Local Planning Authority before such change is made.
Reason: To protect the important species on the site, in accordance with Policy CSB1 of the South Oxfordshire Core Strategy 2027 and Policies C6 and C8 of the South Oxfordshire Local Plan 2011 and Paragraph 170 of the NPPF.
Any external lighting will only be permitted in accordance with a lighting scheme to be first submitted to and approved in writing by the Local Planning Authority. Any such lighting shall be implemented in accordance with the approved details and directed downwards to prevent nuisance to adjoining residential occupiers from light spillage.
Reason: To protect the appearance of the area, the environment and wildlife, and local residents from light pollution in accordance with Policy CSB1 of the South Oxfordshire Core Strategy, Policies G2, C6, C8 and EP3 of the South Oxfordshire Local Plan 2011 and Paragraph 170 of the NPPF.
The development hereby permitted shall only be occupied as visitor accommodation and no part of the accommodation shall be occupied by the same person(s) for a period exceeding 28 days in any 90 day period and shall not be occupied as a person's sole or main place of residence. The owners/operators shall maintain an up-to-date register of the names of all the occupiers of the accommodation, as well as the dates of their arrival and departure and their contact details. This register shall be made available at all reasonable times to the local planning authority.
Reason: The site lies in an area where new development is strictly controlled and the proposal has only been justified on the grounds of its public benefit to local tourism in accordance with Policies CSEM1 and CSR2 of the South Oxfordshire Core Strategy and Policies G2 and TSM1 of the South Oxfordshire Local Plan 2011.
There shall be a maximum of two shepherd huts on site at any one time. The shepherd huts hereby approved shall be removed from the site in the event that their use for visitor accommodation ceases.
Reason: The site lies in an area where new development is strictly controlled and the proposal has only been justified on the grounds of its public benefit to local tourism in accordance with Policies CSEM1 and CSR2 of the South Oxfordshire Core Strategy and Policies G2 and TSM1 of the South Oxfordshire Local Plan 2011.
