Conditions / Refusal Reasons
The development to which this permission relates must be begun not later than 6 November 2022. Reason: By virtue of Sections 91 to 95 of the Town and Country Planning Act 1990 as amended by section 51 of the Planning and Compulsory Purchase Act 2004.

That the development hereby approved shall be carried out in accordance with the details shown on the following approved plans, 3536-200 Rev F, HTS-TPP-01E, HTS-LND-01D and HTS-TCP-01F, except as controlled or modified by conditions of this permission. Reason: To secure the proper planning of the area in accordance with Development Plan policies.

Prior to the construction above slab level of the dwellings hereby approved, samples and / or a photographic schedule of all materials to be used in the external construction and finishes of the development hereby permitted shall be submitted to and approved in writing by the Local Planning Authority. Reason: In the interests of the visual appearance of the development in accordance with Policies CSQ3 and CSEN1 of the South Oxfordshire Core Strategy 2027 and Policies H4 and G2 of the South Oxfordshire Local Plan 2011.

Except in the case of any building work hereby permitted, no change in the levels of the land shall take place unless in accordance with a detailed scheme which shall have been submitted to and approved in writing by the Local Planning Authority before any development commences on site. The scheme shall include details of existing and proposed ground levels. Reason: To ensure a satisfactory form of development in accordance with Policies CSQ3 and CSEN1 of the South Oxfordshire Core Strategy 2027 and Policies H4, G2 and D1 of the South Oxfordshire Local Plan 2011.

Prior to the first occupation of the dwellings hereby permitted the proposed means of access onto Colliers Lane is to be formed and laid out and constructed strictly in accordance with the local highway authority's specifications and all ancillary works specified shall be undertaken. Reason: In the interest of highway safety in accordance with Policy T1 of the South Oxfordshire Local Plan 2011.

Prior to the first occupation of the dwellings hereby permitted, vision splays measuring 2.4 metres by 43 metres shall be provided to each side of the access and the vision splays shall not be obstructed by any object, structure, planting or other material with a height exceeding or growing above 0.9 metres as measured from carriageway level. Thereafter they shall be retained as such. Reason: In the interest of highway safety in accordance with Policy T1 of the South Oxfordshire Local Plan 2011.

Prior to the first occupation of the development hereby approved, the parking and turning areas shall be provided in accordance with the approved plan 3536/200 Rev F and shall be constructed, laid out, surfaced, drained and completed (to be compliant with sustainable drainage (SuDS) principles if permeability tests show it to be feasible), and shall be retained unobstructed except for the parking of vehicles associated with the development at all times. Reason: In the interests of highway safety and in accordance with Policies T1 and T2 of the South Oxfordshire Local Plan 2011.

The garage accommodation hereby approved shall be retained as such and shall not be adapted for living purposes without planning permission from the Local Planning Authority. Reason: In the interests of highway safety and to ensure the provision of adequate off-street car parking in accordance with Policies T1 and T2 of the South Oxfordshire Local Plan 2011.

Prior to the commencement of development, a full surface water drainage scheme shall be submitted to and approved in writing by the Local Planning Authority. The development shall be carried out in accordance with the approved details prior to the first occupation of the development hereby approved. Reason: To prevent pollution and flooding in accordance with Policies EP1, EP4 and EP6 of the South Oxfordshire Local Plan 2011.

Prior to the commencement of development, a full foul water drainage scheme shall be submitted to and approved in writing by the Local Planning Authority. The development shall be carried out in accordance with the approved details prior to the first occupation of the development hereby approved. Reason: To prevent pollution in accordance with Policy EP1 of the South Oxfordshire Local Plan 2011.

The landscaping scheme set out in Appendix F of the Full Arboricultural Method Statement (Dated June 2019) submitted with application P19/S2112/FUL and shown on the Tree Landscaping Plan HTSLND-01D submitted with this application (P20/S0153/FUL) shall be implemented within 12 months of the commencement of the development hereby permitted and thereafter be maintained in accordance with the approved scheme. In the event of any of the trees or shrubs so planted dying or being seriously damaged or destroyed within 5 years of the completion of the development, a new tree or shrub or equivalent number of trees or shrubs, as the case may be, of a species first approved by the Local Planning Authority, shall be planted and properly maintained in a position or positions first approved in writing by the Local Planning Authority. Reason: To help to assimilate the development into its surroundings in accordance with Policies CSEN1 and CSQ3 of the South Oxfordshire Core Strategy 2027 and Policies G2, C9 and D1 of the South Oxfordshire Local Plan 2011.

The tree protection details set out in the Full Arboricultural Method Statement (Dated June 2019) submitted with application P19/S2112/FUL, and Tree Protection Plan HTS-TPP-01E submitted with this application (P20/S0153/FUL) shall be installed prior to any on site works including demolition and thereafter retained in situ for the duration of development. Reason: To safeguard trees which are visually important in accordance with Policies CSEN1 and CSQ3 of the South Oxfordshire Core Strategy 2027 and Policies G2, C9 and D1 of the South Oxfordshire Local Plan 2011

The development hereby permitted shall be implemented strictly in accordance with the measures stated in sections 9.1.1 and 9.4.1 (inclusive) of the supporting Preliminary Ecological Appraisal (John Wenman Ecological Consultancy LLP, July 2019. Ref: R2182/b) submitted with application P19/S2112/FUL in all respects. Any variation from the approved details shall be agreed in writing by the Local Planning Authority before such change is made. Reason: To minimise the impacts of development on biodiversity, in accordance with Policies C6 and C8 of the South Oxfordshire Local Plan 2011, Policy CSB1 of the South Oxfordshire Core Strategy 2027 and paragraph 170 of the NPPF.

Prior to the laying of any foundations on site related to the development hereby approved, a biodiversity enhancement plan (BEP), based on the recommendations made in section 9.5 of the supporting Preliminary Ecological Appraisal (John Wenman Ecological Consultancy LLP, July 2019. Ref: R2182/b) submitted with application P19/S2112/FUL, shall be submitted to and approved in writing by the local planning authority. Thereafter, the BEP shall be implemented in accordance with the approved details. This condition shall be discharged through the receipt of a letter from the project ecologist providing evidence to confirm that the approved measures have been implemented in accordance with this condition. Reason: To secure net gains for biodiversity, in accordance with Policies C6 and C8 of the South Oxfordshire Local Plan 2011, Policy CSB1 of the South Oxfordshire Core Strategy 2027 and paragraph 170 of the National Planning Policy Framework.
