The development to which this permission relates must be begun not later than the expiration of three years beginning with the date of this permission. Reason: By virtue of Sections 91 to 95 of the Town and Country Planning Act 1990 as amended by section 51 of the Planning and Compulsory Purchase Act 2004. Related application(s): P20/S0558/DIS

That the development hereby approved shall be carried out in accordance with the details shown on the following approved plans, 19.160-02 Rev B, 19.160-04, 19.160-03 Rev A, 19.147-02, GF, 1F, LOC 001, 19.160-05 Rev A and 19.160-01, except as controlled or modified by conditions of this permission. Reason: To secure the proper planning of the area in accordance with Development Plan policies. Related application(s): P20/S0558/DIS

That those buildings shown to be demolished specifically the existing dwelling house and existing garage/workshop as shown on drawing 19.160-01 on the plans accompanying the application shall be demolished, and any demolished material which is not to be utilised in the new development shall be removed from the land, before the construction of the replacement dwelling hereby permitted commences, and this provision shall apply unless an alternative scheme for the phased demolition of the building(s) and removal of materials is first submitted to and approved in writing by the Local Planning Authority. Reason: To ensure satisfactory comprehensive development in accordance with Policy CSQ3 and CSEN1 of the South Oxfordshire Core Strategy 2027 and Policies G2, D1 and H12 of the South Oxfordshire Local Plan 2011 and Policies BCS7 and BCS9 of the Brightwell cum Sotwell Neighbourhood Plan. The exterior of the development hereby permitted shall only be constructed in the materials specified on the plans hereby approved or in materials which shall previously have been approved in writing by the Local Planning Authority. Reason: In the interests of the visual appearance of the development in accordance with Policy CSQ3 of the South Oxfordshire Core Strategy 2027 and Policies G2 and D1 of the South Oxfordshire Local Plan 2011 and Policy BCS9 of the Brightwell cum Sotwell Neighbourhood Plan.

Prior to the first occupation of the development hereby approved, the parking and turning areas shall be provided in accordance with the approved plan 19.160-02 Rev B and shall be constructed, laid out, surfaced, drained and completed to be compliant with sustainable drainage (SuDS) principles, and shall be retained unobstructed except for the parking of vehicles associated with the development at all times. Reason: In the interests of highway safety and in accordance with Policies T1 and T2 of the South Oxfordshire Local Plan 2011.

The garage accommodation hereby approved shall be retained as such and shall not be adapted for living purposes without planning permission from the Local Planning Authority. Reason: In the interests of highway safety and to ensure the provision of adequate off-street car parking in accordance with Policies T1 and T2 of the South Oxfordshire Local Plan 2011.

Notwithstanding the provisions of the Town and Country Planning (General Permitted Development) Order 2015 (or any Order revoking or re-enacting that Order), the enlargement, improvement or other alteration of any dwellinghouse as described in Schedule 2, Part 1, Class A and E of the Order shall not be undertaken without obtaining planning permission from the Local Planning Authority. Reason: To ensure the Local Planning Authority retains control over any future development as specified in the condition in the interests of amenity and impact to the North Wessex Downs Area of Outstanding Natural Beauty and in accordance with Policies CSQ3 and CSEN1 of the South Oxfordshire Core Strategy 2027 and Policies G2, D1 and H12 of the South Oxfordshire Local Plan 2011 and Policies BCS7 and BCS9 of the Brightwell cum Sotwell Neighbourhood Plan..

The tree protection details as shown on the approved Phase II Arboricultural Impact Assessment (Ref. 101 379 dated 17/06/2019) shall be put in place prior to any on site works including demolition and thereafter retained in situ for the duration of development. Reason: To safeguard trees which are visually important in accordance with Policies CSEN1 and CSQ3 of the South Oxfordshire Core Strategy 2027 and Policies G2, C9 and D1 of the South Oxfordshire Local Plan 2011 and Policy BCS12 of the Brigthwell cum Sotwell Neighbourhood Plan

That a scheme for the landscaping of the site, including the planting of live trees and shrubs, shall be submitted to and approved in writing by the Local Planning Authority prior to the commencement of the development hereby permitted. The scheme shall be implemented prior to the first occupation or use of the development hereby approved as approved within 12 months of the commencement of the approved development and thereafter be maintained in accordance with the approved scheme. In the event of any of the trees or shrubs so planted dying or being seriously damaged or destroyed within 5 years of the completion of the development, a new tree or shrub or equivalent number of trees or shrubs, as the case may be, of a species first approved by the Local Planning Authority, shall be planted and properly maintained in a position or positions first approved in writing by the Local Planning Authority. Reason: To help to assimilate the development into its surroundings in accordance with Policies CSEN1 and CSQ3 of the South Oxfordshire Core Strategy 2027 and Policies G2, C9 and D1 of the South Oxfordshire Local Plan 2011 and Policy BCS12 of the Brigthwell cum Sotwell Neighbourhood Plan.

Prior to the construction of the new dwelling, a full surface water drainage scheme, including details of the size, position and construction of drainage works, shall be submitted to, and approved in writing by, the Local Planning Authority. The drainage scheme shall be designed to accommodate a 1 in 10 year storm + 40% CC and will be implemented in accordance with the approved details prior to the occupation of the dwelling hereby approved. Reason: To prevent pollution and flooding in accordance with Policies EP1, EP4 and EP6 of the South Oxfordshire Local Plan 2011.

That, prior to the construction of the new dwelling a full foul water drainage scheme shall be submitted to and approved in writing by the Local Planning Authority. The scheme shall include details of the size, position and construction of the drainage scheme, all coupled with calculations to evidence this. The scheme shall be implemented in accordance with the approved details prior to the occupation of the dwelling hereby approved. Reason: To prevent pollution in accordance with Policy EP1 of the South Oxfordshire Local Plan 2011.

The development hereby approved shall be implemented in accordance with section 4 of the supporting Technical Note TN02: Bat Survey and Assessment (Aspect Ecology, 11/06/2019). For the avoidance of doubt, this condition requires, but is not limited to, the erection of a minimum of three bat boxes on site. This condition shall be discharged through the receipt of a letter from the project ecologist providing evidence to confirm that the approved measures have been implemented in accordance with this condition. Reason: To minimise the impacts of development on, and secure net gains for, biodiveristy - in accordance with Policies C6 and C8 of the SOLP, Policy CSB1 of the SOCS, Policy BCS12 of the Brigthwell cum Sotwell Neighbourhood Plan and paragraph 170 of the NPPF.
