Conditions / Refusal Reasons
That the development hereby approved shall be carried out in accordance with the details shown on the following approved plans, K100, K501, K502, K503, K504, K600e, K601c, K605c, K606c, 11888/P16/B and 11888_R04b, except as controlled or modified by conditions of this permission. Reason: To secure the proper planning of the area in accordance with Development Plan policies. Related application(s): P20/S0651/DIS

That those buildings shown to be demolished on the plans accompanying the application shall be demolished, and any demolished material which is not to be utilised in the new development shall be removed from the land, before the development hereby permitted commences, and this provision shall apply unless an alternative scheme for the phased demolition of the building(s) and removal of materials is first submitted to and approved in writing by the Local Planning Authority. Reason: To ensure satisfactory comprehensive development in accordance with Policy CSQ3 of the South Oxfordshire Core Strategy 2027 and Policies G2 and D1 of the South Oxfordshire Local Plan 2011.

The landscaping scheme as shown on the approved plans 11888/P16/B shall be implemented in accordance with Landscape Management Plan No.11888_R04b. Thereafter the landscaping shall be maintained in accordance with the approved scheme and the approved Landscape Management Plan. In the event of any of the trees or shrubs so planted dying or being seriously damaged or destroyed within 10 years of the completion of the development, a new tree or shrub or equivalent number of trees or shrubs, as the case may be, of a species first approved by the Local Planning Authority, shall be planted and properly maintained in a position or positions first approved in writing by the Local Planning Authority. Reason: To help to assimilate the development into its surroundings in accordance with Policies CSEN1 and CSQ3 of the South Oxfordshire Core Strategy 2027 and Policies G2, C9 and D1 of the South Oxfordshire Local Plan 2011; and to preserve the landscape quality and scenic beauty of the Chilterns Area of Outstanding Natural Beauty in accordance with policy CSEN1 of the South Oxfordshire Core Strategy 2027.

Prior to the commencement of any site works (including demolition or site clearance) all trees and shrubs shown to be retained on the approved landscape plan 11888/P16/B shall be protected in accordance with a scheme which complies with the current edition of BS 5837: "Trees in relation to design, demolition and construction". The above scheme shall first have been submitted to, and approved in writing by, the Local Planning Authority. The agreed measures shall be kept in place during the entire course of development. In the event of any of the retained trees or shrubs dying or being seriously damaged or destroyed within 10 years of the completion of the development, a new tree or shrub or equivalent number of trees or shrubs, as the case may be, of a species first approved by the Local Planning Authority, shall be planted and properly maintained in a position or positions first approved in writing by the Local Planning Authority within the next planting season. In the event of the Ash Tree adjacent to the western boundary dying or being seriously damaged or destroyed within 10 years of the completion of the development, a new semi-mature tree of a species first approved by the Local Planning Authority, shall be planted and properly maintained in a position first approved in writing by the Local Planning Authority within the next planting season. Reason: To safeguard trees which are visually important in accordance with Policies CSEN1 and CSQ3 of the South Oxfordshire Core Strategy 2027 and Policies G2, C9 and D1 of the South Oxfordshire Local Plan 2011; and to preserve the landscape quality and scenic beauty of the Chilterns Area of Outstanding Natural Beauty in accordance with policy CSEN1 of the South Oxfordshire Core Strategy 2027.

The development shall be undertaken strictly in accordance with Construction Method Statement dated 26 April 2019 submitted with the planning application. Reason: To protect the occupants of nearby residential properties from noise disturbance in accordance with policy EP2 of the South Oxfordshire Local Plan 2011 and to preserve the safety and convenience of the highway network in accordance with policy T1 of the South Oxfordshire Local Plan 2011.

Notwithstanding the provisions of the Town and Country Planning (General Permitted Development) Order 2015 (or any Order revoking or re-enacting that Order), the enlargement, improvement or other alteration of any dwellinghouse as described in Schedule 2, Part 1, Class A of the Order shall not be undertaken without obtaining planning permission for the Local Planning Authority. Reason: To ensure the Local Planning Authority retains control over any future development as specified in the condition in the interests of amenity and in accordance with Policy CSQ3 of the South Oxfordshire Core Strategy 2027 and Policies G2, D1 and H12 of the South Oxfordshire Local Plan 2011; and to preserve the landscape quality and scenic beauty of the Chilterns Area of Outstanding Natural Beauty in accordance with policy CSEN1 of the South Oxfordshire Core Strategy 2027.

Notwithstanding the provisions of the Town and Country Planning (General Permitted Development) Order 2015 (or any Order revoking or re-enacting that Order), enlargement of the dwelling consisting of an addition or alteration to its roof as described in Schedule 2, Part 1, Class B of the Order shall not be undertaken without obtaining planning permission for the Local Planning Authority. Reason: The specific circumstances of this site warrant the Local Planning Authority having control over any further development as specified in the condition in the interests of amenity and in accordance with Policy CSQ3 of the South Oxfordshire Core Strategy 2027 and Policies G2, D1 and H12 of the South Oxfordshire Local Plan 2011; and to preserve the landscape quality and scenic beauty of the Chilterns Area of Outstanding Natural Beauty in accordance with policy CSEN1 of the South Oxfordshire Core Strategy 2027.

Notwithstanding the provisions of the Town and Country Planning (General Permitted Development) Order 2015 (or any Order revoking or re-enacting that Order) the provision within the curtilage of the dwelling of any building, enclosure or swimming pool as described in Schedule 2, Part 1, Class E of the Order shall not be undertaken without obtaining planning permission for the Local Planning Authority. Reason: To ensure the Local Planning Authority retains control over any future development as specified in the condition in the interests of amenity in accordance with Policy CSQ3 of the South Oxfordshire Core Strategy 2027 and Policies G2, D1 and H13 of the South Oxfordshire Local Plan 2011; and to preserve the landscape quality and scenic beauty of the Chilterns Area of Outstanding Natural Beauty in accordance with policy CSEN1 of the South Oxfordshire Core Strategy 2027.

That the boundary treatments shown on the approved plans shall be implemented within 12 months of the grant of this permission and thereafter, notwithstanding the provisions of the Town and Country Planning (General Permitted Development Order) 2015 (or any Order revoking or re-enacting that Order) the erection or construction of gates, fences, walls or other means of enclosure as described in Schedule 2, Part 2, Class A of the Order shall not be undertaken without obtaining planning permission for the Local Planning Authority. Reason: To ensure the Local Planning Authority retains control over any future development as specified in the condition in the interests of amenity in accordance with Policy CSQ3 of the South Oxfordshire Core Strategy 2027 and Policies G2 and D1 of the South Oxfordshire Local Plan 2011; and to preserve the landscape quality and scenic beauty of the Chilterns Area of Outstanding Natural Beauty in accordance with policy CSEN1 of the South Oxfordshire Core Strategy 2027.

Within 12 months of the grant of this permission, the existing means of access onto the highway shall be improved and laid out and constructed strictly in accordance with the local highway authority's specifications and all ancillary works specified shall be undertaken. Reason: In the interest of highway safety in accordance with Policy T1 of the South Oxfordshire Local Plan 2011.

Within 12 months of the grant of this permission concrete or blacktop should be laid in a strip from the boundary of the driveway with the road to the start of the gravelled area. Reason: To reduce gravel being carried onto the highway in the interests of highway safety and convenience in accordance with Policy T1 of the South Oxfordshire Local Plan 2011.

Within 12 months of the grant of this permission the parking and turning areas shall be provided in accordance with the approved plan K601c and shall be constructed, laid out, surfaced, drained and completed to be compliant with sustainable drainage (SuDS) principles, and shall be retained unobstructed except for the parking of vehicles associated with the development at all times. Reason: In the interests of highway safety and in accordance with Policies T1 and T2 of the South Oxfordshire Local Plan 2011.

No surface water from the development shall be discharged onto the adjoining highway Reason: In the interests of highway safety in accordance with Policy T1 of the South Oxfordshire Local Plan 2011.

The garage accommodation hereby approved shall be retained as such and shall not be adapted for living purposes without planning permission from the Local Planning Authority. Reason: In the interests of highway safety and to ensure the provision of adequate off-street car parking in accordance with Policies T1 and T2 of the South Oxfordshire Local Plan 2011.

The outbuilding hereby permitted shall not be used at any time other than for purposes ancillary to the residential use of the dwelling known as Holly House. Reason: As the separate occupation of the accommodation would represent an undesirable sub-division of the property and result in inadequate standards of amenity and privacy in accordance with Policy H13 of the South Oxfordshire Local Plan 2011.

External lighting will only be permitted in accordance with a lighting scheme to be approved in writing by the local planning authority. Any such lighting shall be directed downwards to prevent nuisance to adjoining residential occupiers from light spillage. Reason: To protect the appearance of the area, the environment and wildlife, and local residents from light pollution in accordance with Policy EP3 of the South Oxfordshire Local Plan 2011.
