Conditions / Refusal Reasons
The development to which this permission relates must be begun not later than the expiration of three years beginning with the date of this permission. Reason: By virtue of Sections 91 to 95 of the Town and Country Planning Act 1990 as amended by section 51 of the Planning and Compulsory Purchase Act 2004.

That the development hereby approved shall be carried out in accordance with the details shown on the following approved plans, 1944 001, 1944 002, 1944 003, 1944 004, 1944 005, 1944 006, 1944 007, 1944 008, 1944 009, 1944 010, 1944 021, 1944 022, 1944 023, 1944 024, 1944 025, LOC 001, 1944 011, 1944 012, 1944 013, 1944 014, 1944 015, 1944 016, 1944 017, 1944 018, 1944 019 and 1944 020, except as controlled or modified by conditions of this permission. Reason: To secure the proper planning of the area in accordance with Development Plan policies.

Prior to the commencement of the development hereby approved a schedule of all materials to be used in the external construction of the detached garage hereby permitted shall be submitted to and approved in writing by the Local Planning Authority. Reason: In the interests of the visual appearance of the development in accordance with Policies CS1, CSEN1, CSEN3 and CSQ3 of the South Oxfordshire Core Strategy 2027 and Policies C4, CON5, D1, G2 and H13 of the South Oxfordshire Local Plan 2011.

That the materials to be used for the alterations to the hard boundary treatment (retaining walls within the gardens) hereby approved shall be of the same colour, type and texture as those used on the existing walls. Reason: In the interests of the visual appearance of the development in accordance with Policies CS1, CSEN1, CSEN3 and CSQ3 of the South Oxfordshire Core Strategy 2027 and Policies C4, CON3, CON5, D1, G2 and H13 of the South Oxfordshire Local Plan 2011.

The first floor window in the north elevation of the detached garage hereby permitted shall be glazed in obscure glass with a minimum of level 3 obscurity, and shall be fixed shut below 1.7 metres from the finished floor level of the room in which it is to be inserted and it shall be retained as such thereafter. Reason: To ensure that the development is not unneighbourly in accordance with Policies D4 or H13 of the South Oxfordshire Local Plan 2011.

The garage accommodation hereby approved shall be retained as such and shall not be adapted for living purposes without planning permission from the Local Planning Authority. Reason: In the interests of highway safety and to ensure the provision of adequate off-street car parking in accordance with Policies D2 and T2 of the South Oxfordshire Local Plan 2011.

The first floor accommodation within the detached garages hereby permitted shall not be occupied at any time other than for purposes ancillary to the residential use of the dwelling known as Backus. Reason: As the separate occupation of the accommodation would represent an undesirable sub-division of the property and result in inadequate standards of amenity and privacy in accordance with Policy H13 of the South Oxfordshire Local Plan 2011.
