Conditions / Refusal Reasons
That, having regard to the location of the site in relation to the existing surrounding development, plot size and siting of the proposed dwelling, the proposal would result in a cramped, and incongruous form of development. In addition, the access down the side of number 5 Fairacres Road would result in a contrived form of development. Together, this would detract from the spacious established character and visual amenity of the locality contrary to policy CSQ3 of the South Oxfordshire Core Strategy, policies G2, D1 and H4 of the South Oxfordshire Local Plan 2011, to advice within the NPPF and to advice within Section 7 of the South Oxfordshire Design Guide 2016.
The proposal would give rise to issues of highway safety and is contrary to policies T1 and T2 of the South Oxfordshire Local Plan 2011 and to section 6 of the South Oxfordshire Design Guide for the following reasons:
) Vehicular tracking shown on the submitted plans is substandard. No tracking has been demonstrated for the proposed parking spaces
ii) No turning opportunity has been demonstrated for delivery and emergency vehicles. If these vehicles can not access the site, they would have to perform a difficult reverse manoeuvre which would adversely impact on highway safety and the users of the highway.
iii) No visibility splays have been shown for the users of the shared access. If these are not provided, it will lead to an increase risk to highway safety. Forward visibility from the parking/turning area to the existing turning head for Fairacres Road is limited, therefore it is likely that conflict will occur between accessing and egressing vehicles requiring either vehicle to carry out a likely difficult reverse gear manoeuvre.
iv) The red site area does not abut the highway therefore access rights appear to cross third party land.
That insufficient information in relation to foul water drainage works have been submitted to demonstrate that the proposal would not prevent pollution contrary to Policy EP1 of the South Oxfordshire Local Plan 2011.
