The former caravan lying immediately north of the commercial site at Chinnor Turf & Paving Suppliers, Bartons
Springfield Gardens has been extended and altered such that it can no longer comply with the definition and operational testing of a 'caravan' under sections 29 and 13 of Caravan Sites Act 1968 (The 1968 Act) and Social Landlords (Permissible Additional Purposes) (England) Order 2006 (Definition of Caravan) (Amendment) (England) Order 2006, and is now considered to be a 'building' under Section 55 of the Town and Country Planning Act (TCPA) 1990. Form the information supplied, it is evident that the existing building on site has been arranged as such since December 2012 and has, on the balance of probability, been in continuous occupation as a dwellinghouse for a period of four year or more, prior to the point of the receipt of this application, 9 December 2019. The small parcel of former agricultural land surrounding the building is landscaped with areas of hard standing and mature planting to provide a modest residential curtilage, enclosed with a timber close board fence and has, on the balance of probability, been in continuous use as residential land for a period of ten year or more, prior to the point of the receipt of this application, 9 December 2019. As such, the proposed use and development described in the supporting documents and as shown on drawings LOC001 A, 19-039-01 A and 19-039-02 A accompanying this application is considered to be immune from any planning enforcement and lawful due to passage of time under sections 191 and 171 of the Town and Country Planning Act 1990.
