Conditions / Refusal Reasons
The development to which this permission relates must be begun not later than the expiration of three years beginning with the date of this permission.
Reason: By virtue of Sections 91 to 95 of the Town and Country Planning Act 1990 as amended by section 51 of the Planning and Compulsory Purchase Act 2004.
That the development hereby approved shall be carried out in accordance with the details shown on the following approved plans, 904, 902, 901, 903, 1810-D05-B, 1810-900-D, 1810-D08-B, 1810-D09-B, 1810-D06-E, 1810-D07-A, 1810-D01-A, 1810-D04-B, 1810-D03-B and 1810-D01 A, except as controlled or modified by conditions of this permission.
Reason: To secure the proper planning of the area in accordance with Development Plan policies.
The exterior of the development hereby permitted shall only be constructed in the materials specified on the plans hereby approved or in materials which shall previously have been approved in writing by the Local Planning Authority.
Reason: In the interests of the visual appearance of the development in accordance with Policies CSEN1 and CSQ3 of the South Oxfordshire Core Strategy 2027 and Policies G2, E8 and D1 of the South Oxfordshire Local Plan 2011.
Details, including drawings as necessary, in respect of the new windows and doors shall be submitted to, and approved in writing by, the Local Planning Authority prior to the commencement of the scheme. Thereafter the works shall be carried out in accordance with the approved details.
Reason: To safeguard the special architectural and historic interest of the non-designated heritage asset, in accordance with Paragraph 197 of the National Planning Policy Framework.
Notwithstanding the provisions of the Town and Country Planning (General Permitted Development) Order 2015 (or any Order revoking or re-enacting that Order), the enlargement, improvement or other alteration of any dwellinghouse as described in Schedule 2, Part 1, Class A of the Order shall not be undertaken without obtaining planning permission from the Local Planning Authority.
Reason: To ensure the Local Planning Authority retains control over any future development as specified in the condition in the interests of amenity and in accordance with Policies CSEN1 and CSQ3 of the South Oxfordshire Core Strategy 2027 and Policies G2, E8 and D1 of the South Oxfordshire Local Plan 2011.
Notwithstanding the provisions of the Town and Country Planning (General Permitted Development Order) 2015 (or any Order revoking or re-enacting that Order) the erection or construction of gates, fences, walls or other means of enclosure as described in Schedule 2, Part 2, Class A of the Order shall not be undertaken without obtaining planning permission from the Local Planning Authority.
Reason: To ensure the Local Planning Authority retains control over any future development as specified in the condition in the interests of amenity in accordance with Policies CSEN1 and CSQ3 of the South Oxfordshire Core Strategy 2027 and Policies G2, E8 and D1 of the South Oxfordshire Local Plan 2011.
Any external lighting will only be permitted in accordance with a lighting scheme to be first submitted to and approved in writing by the Local Planning Authority prior to the first occupation of the development hereby approved. Any such lighting shall be implemented in accordance with the approved details and directed downwards to limit light spillage.
Reason: To protect the appearance of the area, the environment and wildlife in accordance with Policies CSB1 and CSEN1 of the South Oxfordshire Core Strategy 2027 and Policies C8, D1, G2 and EP3 of the South Oxfordshire Local Plan 2011.
Prior to the commencement of any works to the existing barn, evidence of the successful receipt of a European protected species licence, or evidence of the successful registration of the site under the bat mitigation class licence, from Natural England, specific to this development, shall be submitted to and approved in writing by the local planning authority.
Reason: To protect the important species on the site, in accordance with provisions of the NPPF and Policy CSB1 of the South Oxfordshire Core Strategy 2027 and Policy C8 of the South Oxfordshire Local Plan 2011.
Prior to the commencement of the development hereby approved, a detailed specification of the integrated bat loft shown on drawing D05 Rev B , including location of bat access points, insulation and roofing membrane specifications, and a detailed working method statement for the works of the barn in relation to bats, shall be submitted to and approved in writing by the local planning authority. Thereafter the development shall be implemented and maintained in accordance with the approved details.
Reason: To protect the important species on the site, in accordance with provisions of the NPPF and policies CSB1 of the South Oxfordshire Core Strategy 2027 and C8 of the South Oxfordshire Local Plan 2011.
Prior to the commencement of development, a full surface water drainage scheme, including details of the size, position and construction of drainage works, shall be submitted to, and approved in writing by, the Local Planning Authority. The drainage scheme shall be designed to accommodate a 1 in 10 year storm + 40% CC and shall be implemented in accordance with the approved details prior to the occupation of the development hereby approved.
Reason: To prevent pollution and flooding in accordance with Policies EP1, EP4 and EP6 of the South Oxfordshire Local Plan 2011.
Prior to the commencement of development, a full foul water drainage scheme shall be submitted to and approved in writing by the Local Planning Authority. The development shall be carried out in accordance with the approved details prior to the first occupation of the development hereby approved.
Reason: To prevent pollution in accordance with Policy EP1 of the South Oxfordshire Local Plan 2011.
The off-site highway works shown on approved plan (D09, Rev B) or as otherwise agreed in writing with the Local Planning Authority shall be implemented in full before the first occupation/use of the development or in accordance with a programme of implementation agreed in writing with the Local Planning Authority.
Reason: In the interest of highway safety in accordance with Policy T1 of the South Oxfordshire Local Plan 2011.
The garage building shall only be used for purposes incidental to the residential use of the new dwelling.
Reason: The independent residential use of the building would be contrary to the spatial strategy of the Development Plan, as set out under Policies CS1, CSH1 and CSR1 of the South Oxfordshire Core Strategy 2027..
Prior to the first occupation of the development hereby approved, the parking and turning areas shall be provided in accordance with the approved plan (D06, Rev E) and shall be constructed, laid out, surfaced, drained and completed to be compliant with sustainable drainage (SuDS) principles, and shall be retained unobstructed except for the parking of vehicles associated with the development at all times.
Reason: In the interests of highway safety and in accordance with Policies T1 and T2 of the South Oxfordshire Local Plan 2011.
All tree protection measures described within the approved Tree Survey and Protection Plan (NGTS301200, 14/02/2020) and the subsequent Arboricultural Method Statement for the driveway widening (NGAMS301200-001, 7/4/2020) shall be put in place prior to any on site works including demolition and thereafter retained in situ for the duration of development.
Reason: To safeguard trees which are visually important in accordance with Policies CSEN1 and CSQ3 of the South Oxfordshire Core Strategy 2027 and Policies G2, C9 and D1 of the South Oxfordshire Local Plan 2011
Prior to the commencement of the development a phased risk assessment shall be carried out by a competent person in accordance with current government and Environment Agency Guidance and Approved Codes of Practice. Each phase shall be submitted to and approved in writing by the Local Planning Authority.
Phase 1 shall incorporate a desk study and site walk over to identify all potential contaminative uses on site, and to inform the conceptual site model. If potential contamination is identified in Phase 1 then a Phase 2 investigation shall be undertaken.
Phase 2 shall include a comprehensive intrusive investigation in order to characterise the type, nature and extent of contamination present, the risks to receptors and if significant contamination is identified to inform the remediation strategy.
Phase 3 requires that a remediation strategy be submitted to and approved by the LPA to ensure the site will be rendered suitable for its proposed use.
Reason: To ensure that any ground, water and associated gas contamination is identified and adequately addressed to ensure the safety of the development, the environment and to ensure the site is suitable for the proposed use in accordance with Policy EP8 of the South Oxfordshire Local Plan 2011.
