Conditions / Refusal Reasons
The development to which this permission relates must be begun not later than the expiration of three years beginning with the date of this permission. Reason: By virtue of Sections 91 to 95 of the Town and Country Planning Act 1990 as amended by section 51 of the Planning and Compulsory Purchase Act 2004. Related application(s): P20/S3280/DIS

That the development hereby approved shall be carried out in accordance with the details shown on the following approved plans, 1201 P7, 2200 P7, 3000 P7, 082-201 P5, 082-001 P4, 1706.L.1000, 082-002 P6 and 1020 P2, except as controlled or modified by conditions of this permission. Reason: To secure the proper planning of the area in accordance with Development Plan policies.

The exterior of the garden room hereby permitted shall only be constructed using the brick and timber materials set out within material schedule 18047_T05_007_P2 approved under reference P20/S0299/DIS and a slate tile to be submitted to and approved in writing by the Local Planning Authority prior to the commencement of the relevant part of the development. Reason: In the interests of the visual appearance of the development in accordance with Policies CSEN3 and CSQ3 of the South Oxfordshire Core Strategy 2027, Policies CON7, C3, D1, G2 and H13 of the South Oxfordshire Local Plan 2011 and Policies 11 and 16 of the Goring on Thames Neighbourhood Plan.

The tree protection measures set out in the submitted Arboricultural Method Statement V1 dated March 2020 and shown on the Tree Protection Plan, Ref HTS-TPP-01E and the tree protection measures set out in the submitted Detailed Arboricultural Method Statement reference Pavillion_DAMS_SM_JP_30042019v7 and on the Tree Protection Plan drwgno 190519-TP-TPP-Rev A-SM, approved for application P19/S1699/FUL shall be put in place prior to any on site works including demolition and thereafter retained in situ for the duration of development. Reason: To safeguard trees which are visually important in accordance with Policies CSEN1 and CSQ3 of the South Oxfordshire Core Strategy 2027 and Policies C9, D1 and G2 of the South Oxfordshire Local Plan 2011 and Policies 11 and 12 of the Goring on Thames Neighbourhood Plan.

The development shall be carried out in accordance with the FRA amendment addendum prepared by RMA Environmental, reference RMA/LC1756G_3, dated 5 February 2020, and the Flood Risk Assessment, prepared by RMA Environmental, reference RMA-C1949, dated 9 October 2019, and the following mitigation measures it details: - All habitable rooms including kitchens, living rooms, bedrooms and studies will be located at the first floor level. - Flood resilient measures as specified within the FRA amendment addendum prepared by RMA Environmental, reference RMA/LC1756G_3, dated 5 February 2020, will be incorporated into the design for the ground floor. The mitigation measure(s) shall be fully implemented prior to occupation and subsequently in accordance with the timing / phasing arrangements embodied within the scheme, or within any other period as may subsequently be agreed, in writing, by the local planning authority Reason: This condition is sought in accordance with paragraph 163 of the National Planning Policy Framework to reduce the risk of flooding on-site and elsewhere. In particular to prevent: flooding elsewhere by ensuring that the flow of flood water is not impeded and the proposed development does not cause a loss of flood plain storage and to prevent the increased risk of flooding due to impedance of flood flows and reduction of flood storage capacity.

The landscaping scheme as shown on the approved plan reference 082-201 P5 shall be implemented prior to the first occupation or use of the approved development and thereafter be maintained in accordance with the approved scheme. In the event of any of the trees or shrubs so planted dying or being seriously damaged or destroyed within 5 years of the completion of the development, a new tree or shrub or equivalent number of trees or shrubs, as the case may be, of a species first approved by the Local Planning Authority, shall be planted and properly maintained in a position or positions first approved in writing by the Local Planning Authority. Reason: To help to assimilate the development into its surroundings in accordance with Policies CSEN1 and CSQ3 of the South Oxfordshire Core Strategy 2027, Policies C9, D1 and G2 of the South Oxfordshire Local Plan 2011 and Policies 11 and 12 of the Goring on Thames Neighbourhood Plan.

The provision and management of the 10 metre wide buffer zone alongside the River Thames shall be carried out in accordance with the River Buffer Zone Landscape Plan drwgno 082-002 P6 hereby approved and any subsequent amendments shall be agreed in writing with the local planning authority. Reason: This condition is sought in accordance with paragraph 170, 174 and 175 of the NPPF, Policies C6 and C8 of the South Oxfordshire Local Plan 2011 and Policies 11 and 12 of the Goring on Thames Neighbourhood Plan so that the development contributes and enhances the natural and local environment by minimising impacts on and providing net gains for biodiversity, is adequately mitigated and secures measurable net gains for biodiversity.

The landscape management plan reference 082-SP-01 Revision P2 dated 30 April 2020 hereby approved shall be carried out as approved and any subsequent variations shall be agreed in writing by the local planning authority. Reason: This condition is sought in accordance with paragraph 170, 174 and 175 of the NPPF, Policies C6 and C8 of the South Oxfordshire Local Plan 2011 and Policies 11 and 12 of the Goring on Thames Neighbourhood Plan so that the development contributes and enhances the natural and local environment by minimising impacts on and providing net gains for biodiversity, is adequately mitigated and secures measurable net gains for biodiversity.

Prior to the first occupation of the garden room hereby approved the route of the foul water drainage to the building shall be carried out in accordance with the drainage layout plan reference: 8868-HYD-00-XX-DR-C-7720 P02 approved under P19/S1699/FUL. This is notwithstanding the absence of the alterations to the garden room and the introduction of the mooring inlet hereby approved from that plan. Reason: To prevent pollution in accordance with Policy EP1 of the South Oxfordshire Local Plan 2011 and Policy 15 of the Goring on Thames Neighbourhood Plan.
